HomeMy WebLinkAboutResolution No. 3254124 RESOLUTION NO. 3254 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 87 -11 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to locate a single truck loading dock facing an arterial street (Holder Street) for Mitsubishi Motor Sales of America, Inc., at 6400 Katella Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: (1) To provide for the classification and development of parcels of land as coordinated, comprehensive projects so as to take advantage of the superior environment which can result from large -scale community planning. (2) To allow diversification of land uses as they relate to each other in a physical and environmental arrangement, while insuring substantial compliance with the provisions of this Ordinance. (3) To provide for a zone encompassing various types of land uses, such as single - family residential developments, multiple housing developments, professional and administrative office areas, commercial centers, industrial parks or any public or semi - public use or combination of uses through the adoption of a Development Plan and text materials which set forth land use relationships and development standards. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The loading dock is for service deliveries only, for the office building and cafeteria. (2) Number of deliveries are limited to six per day. (3) The loading dock's hours of operation are limited from 7 a.m. to 6 p.m. only, Monday through Saturday. (4) The loading dock will be adequately screened from Holder Street with landscaping and a visual screen if necessary. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." The loading dock shall be recessed to a sufficient depth where the height of the loading area platform shall not exceed that of the adjacent parking lot. 2. The dock shall be adequately screened from Holder Street by landscaping approved in writing by the Planning Director. This landscaping shall be shown on the detailed landscape plan for Design Review Committee No. 87 -24. 3. The loading dock shall be used only for service deliveries for the office building and cafeteria. The loading dock shall not be utilized for delivery of merchandise for resale. 4. No more than six (6) truck turnarounds shall be allowed at the truck dock per day. 5. The business hours of operation in relation to truck dock activity shall be limited from 7 a.m. to 6 p.m. only, on Monday through Saturday. Late night or early morning deliveries shall be specifically prohibited. 6. The loading facility shall not exceed a maximum width of twenty feet (20'). 7. The loading facility shall be located within a fully enclosed structure (i.e., no exterior loading dock), with doors of a color compatible with the main building. 8. Trucking areas shall be adequately paved for the type of operation intended to the satisfaction of the Engineering Department. 9. All applicable conditions of Conditional Use Permit No. 82 -13 and Design Review Committee No. 87 -24 shall be satisfied prior to use of the loading dock. 10. If needed, a visual screen, approved by the Planning Director, shall be installed prior to occupancy and shall be of a color compatible with the headquarters building.
