HomeMy WebLinkAboutResolution No. 3267RESOLUTION NO. 3267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SUPERSEDING RESOLUTION NO.2903 AND SETTING FORTH THE LOCAL CONDITIONS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT MODIFICATIONS TO CERTAIN OF THE FOLLOWING CODES ARE REASONABLE REQUIRED BY LOCAL CONDITIONS WITHIN THE CITY OF CYPRESS: THE 1985 EDITION OF THE UNIFORM BUILDING CODE, THE 1985 EDITION OF THE UNIFORM MECHANICAL CODE, THE 1985 EDITION OF THE UNIFORM HOUSING CODE, THE 1985 EDITION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, THE 1985 EDITION OF THE UNIFORM FIRE CODE, THE 1985 EDITION OF THE BUILDING CODE STANDARDS, AND THE 1985 EDITION OF THE UNIFORM FIRE CODE STANDARDS. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Health and Safety Code Section 17922 requires the City of Cypress to adopt the most current editions of the Building Codes; and 141 WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council to make changes or modifications in the most current editions of the Building Codes as may be reasonably necessary because of certain local conditions; and WHEREAS, the Building Official of the City of Cypress has determined and recommended that, based upon certain local conditions within the City of Cypress, the modifications to the 1985 editions of the Building Codes contained in Ordinance No. 779 are reasonably required to be adopted by the City of Cypress; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications in the most current editions of the Building Codes; and WHEREAS, it is appropriate to describe the specific local conditions upon which each said modification is based. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that the following amendments and modifications to the 1985 editions of the Building Codes contained in Ordinance No. 779 are hereby found to be reasonable necessary due to consideration of specific local climatic, geological, or topographical conditions as follows: I. UNIFORM BUILDING CODE, 1985 EDITION A. Local climate conditions necessitate special precautions to minimize potential roof fires. (Affects Sections 301, 305, 3202 and 3203) B. Local geological conditions necessitate special structural inspections to minimize potential damage from seismic loads. (Affects Section 306.) C. Local climatic conditions require special protection of certain areas and types of materials from moisture damage. (Affects Sections 510 and 2504) D. Local climate conditions necessitate special fire - related precautions for occupants. (Affects Sections 1210 and 1715) E. Modifications to Sections 205 and 5301 and other modifications are administrative amendments of local discretion. F. Local climate geography, topography and high density conditions necessitate the need for a high level of fire protection. (Affects Section 508 and 3802) II. UNIFORM MECHANICAL CODE, 1985 EDITION A. All modifications to this Code are administrative amendments of local discretion. III. UNIFORM HOUSING CODE, 1985 EDITION A. All modifications to this Code are administrative amendments of local discretion. 142 IV. UNIFORM FIRE CODE, 1985 EDITION A. Local climatic conditions necessitate special fire - related precautions for occupants. (Affects Sections 10.306, 10.307, 81.106, and 81.107) B. Local climatic conditions require special restrictions on sale and display of fireworks. (Affects Sections 78.102, 78103 and 78.104) C. Local topographic and climatic conditions necessitate defining high - fise buildings for fire protection purposes. (Affects Section 10.315) D. Modifications to Sections 3.101, 10.206, 10.207, 10.208, 79.1206 and other modificaitons are administrative amendments of local discretion. E. Local climatic, geographic and topographic and high density conditions necessitate the need for a higher leval of fire protection. (Affects Section 10,308) F. Local high density construction and type of construction necessitate more restrictive controls. (Affects Section 61,106) BE IT FURTHER RESOLVED that a copy of this Resolution, together with a copy of Ordinance No. 779 adopting the 1985 editions of the Building Codes, as amended, be filed with the State Department of Housing and Community Development. PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 13th day of July 1987.
