HomeMy WebLinkAboutResolution No. 3273156 RESOLUTION NO. 3273 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 87 -13 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to establish a duplicate bridge and learning center in an existing office building located at 6101 Ball Road. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended as an area for the location of retail and wholesale commercial activities. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) Maximum occupancy is specifically limited to a maximum of 49 persons to ensure compliance with applicable building codes and that existing off - street parking will be adequate to accommodate the bridge learning center. (2) This conditional use permit solely authorizes the playing of "duplicate bridge" games sanctioned by the American Contract Bridge League and shall not be converted to a game of chance in which wagering or the awarding of anything of value takes place. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." The applicant shall comply with all requirements of the City Code. 2. All requirements of the Orange County Fire Marshal's Office and Cypress Building and Safety Department shall be satisfied prior to commencement of the business operation. 3. This conditional use permit solely authorizes the playing of "duplicate bridge" games sanctioned by the American Contract Bridge League. This conditional use permit shall not be converted to a game of chance in which wagering or the awarding of anything of value takes place in accordance with Sections 17.5 through 17.7 of the Cypress Municipal Code. 4. The sale and /or consumption of alcoholic beverages shall not be permitted on the business premises at any time. 5. The business premises shall be open to inspection by the Cypress Police Department during all hours of operation. 6. This conditional use permit shall be the subject to the ongoing jurisdiction of the City of Cypress. Should the City Council determine that the business is conducted in a manner detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity, the City Council may, at its discretion, call a public hearing to review the conditional use permit and add additional conditions, modify, or rescind the conditional use permit. The City Council also retains the right to call a public hearing (at its discretion) to limit the occupancy, number of bridge tables, and /or Bridge Learning Center's hours of operation upon finding that additional parking is required in the subject building. 7. The applicant shall obtain a business license prior to the commencement of the business operation. 8. The total number of bridge tables in the lease unit shall be twelve (12) 'OE less. Maximum occupancy'of the lease unit shall not exceed 49 persons at any time. Any increase in the maximum occupancy shall require an amendment to this conditional use permit and shall be based on a finding that the expansion meets building code requirements and that there is adequate off - street parking to accommodate the additional persons. Violation of this condition shall constitute grounds for revocation of the conditional use permit. 158 2 9. Prior to any expansion of the use, the applicant shall request that the City, at the applicant's expense, conduct a study of the parking needs for the Bridge Learning Center and available off - street parking. Based upon this study, the City Council may (at its discretion) call a public hearing to modify the maximum occupancy.
