A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 87 -15 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER-
MINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of
the City of Cypress to establish a church, Sunday School and related edu-
cational uses on a portion of the Mackay Elementary School site at 8721
Cypress Avenue.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is:
To permit adequate identification of areas reserved
and developed for public uses other than street rights -
of way, to provide for expansion of their operations
or change in use and to identify and preserve areas of
historic and community significance for the enjoyment
of future generations.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) The operation of the church and associated Sunday
School should not be any more detrimental to the surround-
ing community than the former public elementary school in
that adequate parking will be provided onsite and hours of
church services are subject to regulation by the City Council.
(2) Occupancy of the subject property will reduce the
potential for vandalism since the Mackay School has been
vacated and closed by the Cypress School District.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 13th day of July 1987.

CONDITIONAL USE PERMIT NO. 87 -15
CONDITIONS OF APPROVAL
1. The applicant shall conform to all applicable provisions of
the City Code.
2. A twenty- four -foot (24') wide asphalt concrete driveway
shall be installed to connect the asphalt concrete
parking /playground area to the parking lot at Cypress
Avenue. Location of the new driveway shall be subject to
the approval of the City Engineer. The driveway shall be
constructed with a minimum section of two -inch (2 ") asphalt
concrete over four -inch (4 ") crushed aggregate base.
The above improvements shall be shown on a grading plan
using actual grades from an Orange County surveyor's
benchmark, signed by a registered Civil Engineer. The
grading permit shall be paid.
Condition 2 may be waived for one (1) year, during which
time the applicant shall provide a graded, temporary surface
of oiled gravel, or equivalent, to the satisfaction of the
City Engineer.
3. On- street parking will not be permitted for the applicant's
activities.
4. The asphalt concrete parking /playground area shall be
striped for parking. A parking plan, to scale, shall be
submitted to the Planning Director and City Engineer for
approval.
5. It shall be the responsibility of the applicant to
coordinate the requirements of this conditional use permit
with other applicants at this site and the property owner.
6. All existing public improvements at the development site
which are damaged or cracked due to construction shall be
removed and replaced to the satisfaction of the City
Engineer.
7. Buildings shall comply with the regulations of Titles 19 and
24, California Administrative Code for Church (Public
Assembly use).
8. Plans for any proposed signage shall receive final approval
from the City Design Review Committee.
9. Any changes or expansion of the proposed use beyond what is
approved as part of Conditional Use Permit No. 87 -15 will
require an amendment to the conditional use permit.

10. Any change in the applicant's hours of operation which may
conflict with the preschool business must be approved by the
City Council.
11. Should the increase in vehicle trips on Cypress Avenue
demonstrate the need for another access point, the City may
require the applicant to install a driveway off of Walker
Street. Traffic on Cypress Avenue will be monitored by the
Department of Public Works.
12. The Mackay Elementary school site shall be available for
publicly scheduled recreational uses during those hours when
the fields are not specifically being used by the church or
its related organizations.
13. This conditional use permit shall expire and become void one
(1) year from the date of initial approval unless prior to
that time a public hearing is held and the time for the
conditional use permit is extended.
