HomeMy WebLinkAboutResolution No. 3287RESOLUTION NO. 3287 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 87 -2 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for an amendment to an existing con- ditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct a jacuzzi at a motel located at 5311 Lincoln Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the amendment to the conditional use permit is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Commercial Heavy Zone To provide appropriately located areas for establish- ments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. Lincoln Avenue Combining (Overlay Zone) To promote a revitalization of the commercial areas on Lincoln Avenue and thereby enhance the economic base of the City. To improve the image of the City by providing an aes- thetically pleasing environment along Lincoln Avenue. To expand opportunities for the development of identi- fied deep lots by providing a means for the establishment of a variety of urban uses in conjunction with commercial projects. b. The proposed location of the amendment to conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materi- ally injurious to properties or improvements in the vicinity in that: (1) Lincoln Avenue contains sufficient improvements to accommodate any additional traffic generated by this traffic. (2) The proposed use is compatible with the goals and objectives of the General Plan of the City's Zoning Ordinance. (3) The proposed project will result in the demolition of an older structure and the replacement of a newly constructed motel. (4) No kitchenettes are proposed for the motel. (5) Conditions of approval have been required in an attempt to prohibit long -term occupancy. (6) The applicant has agreed to meet additional con- ditions of approval to help ensure that the motel will obtain a rating equivalent to an American Automobile Association two -star motel. c. The proposed amendment to conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 133 184 4. The City Council DOES HEREBY GRANT said amendment to conditional use permit, subject to the conditions attached hereto as Exhibit "A." PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 10th day of August 1987. All conditions of Conditional Use Permit No. 87 -2 shall remain valid. 2. All rooms shall be sound proofed. The building shall be constructed with insulation on all walls and between floors, per Building Department standards. Double paned windows shall be installed on all windows fronting on Lincoln Avenue. 3. A color board indicating the carpeting, draperies, and bedspread that will be in the rooms, and the floor layout indicating style, type and placement of the furniture shall be reviewed and approved by the Planning Department and Automobile Club of Southern California representatives. 4. All rooms shall contain a closet with doors, per Automobile Club standards. 5. An electrical switch, which turns on a light, shall be located at the door of the motel room. 6. Electrical outlets shall be reviewed and approved by Planning Department and Automobile Club representatives. 7. Bathrooms shall be redesigned in order to provide larger counter tops, per City and Automobile Club standards. 8. Sink and counter top shall be constructed of tile or porcelain. 9. A jacuzzi shall be constructed in the exercise room.
