HomeMy WebLinkAboutResolution No. 3294204 RESOLUTION NO. 3294 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW AN EXISTING ENCLOSED PATIO TO REMAIN WITH A SIX AND ONE -HALF -FOOT REAR SETBACK INSTEAD OF THE MINIMUM REQUIRED TEN -FOOT REAR SETBACK. VARIANCE NO. 87 -8 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to allow an existing enclosed patio to remain with a six and one - half -foot rear setback instead of the minimum required ten -foot rear setback. The subject property is located at 4267 Avenida Sevilla in the RS -6,000 Single - Family Residential Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. Strict or literal interpretation and enforcement of the speci- fied regulations would result in practical difficulty or necessary physical hardship in that the subject parcel is smaller and narrower than the standard lot size for the city. b. There are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because of the reduced size of the subject property. c. Due to the reduced size of the parcel, this variance will not constitute the granting of a special privilege. d. The granting of the variance will not be detrimental to the public health, safety, welfare, or materially injurious to properties or improvements in the vicinity because it will meet all building code safety requirements and it will be reviewed for aesthetic compatibility with surrounding proper- ties under the Cypress design review process. 4. The City Council DOES HEREBY GRANT said variance subject to the following conditions: a. The applicant shall comply with all requirements of the City Code except for approved variances or adjustments. b. The applicant shall modify the enclosed patio to ensure compliance with the California Uniform Building Code. Pro - posed plans shall be reviewed and approved by the City of Cypress Building Official, prior to the issuance of a build- ing permit and occupancy permit. c. The applicant shall submit final elevations showing all exterior materials and color schemes to the Planning Depart- ment for approval prior to the issuance of building permits.
