RESOLUTION NO. 3058
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 86 -11 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance in
the City of Cypress to construct a new parish hall, an office addition and
to remodel an existing educational building at the Holy Cross Lutheran Church,
4321 Cerritos Avenue.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is:
This zone is intended as an area for single- family,
urban residential development on minimum lot sizes
of 6,000 square feet and maximum densities of 5.0
dwelling units per acre. Only those additional uses
are permitted that are complimentary to, and can
exist in harmony with, a residential neighborhood.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) The subject property is currently utilized for
church related activities. The proposal is
similar in nature to the existing uses of the
property.
(2) The subject property has adequate off - street
parking for the proposed church uses.
(3) Cerritos Avenue can accommodate the increase
in vehicular traffic which will be generated
by this land use.
(4) The Holy Cross Lutheran Church has operated at
the subject location since 1963. The City is
not aware of any problems created as a result
of a church use at this location. •
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 10th day of March 1986.

CONDITIONAL USE PERMIT NO. 86 -11
1. The developer shall conform to all applicable provisions of the City Code.
2. Drainage shall be solved to the satisfaction of the City Engineer. A
grading plan or revised grading plan, signed by a registered California
civil engineer and using actual grades from an Orange County surveyor's
benchmark, shall be submitted for approval. In parking areas, AC shall
have a minimum slope gradient of two percent (2 %), and concrete shall
have a minimum slope gradient of two - tenths percent (.2%).
3. Wheelchair and handicapped access facilities shall be installed in
accordance with State of California and City of Cypress Public Works
Department standards.
4. All existing public improvements at the development site which are damaged
due to construction, cracked, or otherwise below standard, shall be
removed and replaced to the satisfaction of the City Engineer.
5. A seven and one-half-foot (7',') wide by twenty -foot (20') wide cracked
section of the easterly drive approach shall be removed and replaced per
City standards.
6. The most southerly parking stalls and aisle at the rear of the property
shall be restriped to circulate in an easterly direction for full traffic
circulation of the parking lot. The westerly twenty feet (20') of the
parallel parking stalls at the north property line shall be striped and
marked for no parking. The southwest parking stall in the parking lot
south of the existing chapel shall be striped and marked for nu parking
for turnaround purposes.
Utility services shall he installed underground.
8. Street trees (15 gallons) forty feet (10') on center shall he installed
in back of public sidewalk in conformance to the street tree policy of
the Public Works Department and shall be incorporated with the onsite
landscape plan. The type of trees shall be as required by the City's
street tree ordinance.
D. All product and material ,torage shall occur within the building.
Exterior storage is specifically prohibited.
• 10. The developer shall not erect or display on the subject property any signs
which have not been approved in writing by the Planning Department.
11. All root mounted equipment, such as heating and air conditioning units,
shall he adequately screened from public view subject to the approval of
City staff.
12. The compact parking space shall be denoted as such on the asphalt as
"Compact Only."

13. A detailed landscape and automatic irrigation plan shall be submitted
to the Planning Department for review and approval at least sixty (60)
days prior to issuance of a Certificate of Occupancy. In addition, a
bond shall be posted with the Public Works Department to guarantee
atainst any defects in plant materials and workmanship.
14. The developer shall provide an adequate number of trash enclosures
onsite and at a location acceptable to City staff.
15. Architectural elevations and site plans shall he reviewed and approved
by the Planning Department prior to Building Department plan check
submittal.
16. Parking for the handicapped shall be provided in accordance with State
requirements.
17. All architectural treatments shall be constructed as illustrated on
plans and renderings submitted. The final exterior color scheme shall
be submitted to City staff for review and approval prior to actually
painting the structure.
18. All requirements of the Orange County Fire Marshall's Office, Orange
County Health Department and Cypress Building and Safety Department shall
be satisfied prior to occupancy of the buildings.
19. The City Council shall maintain the right to review Conditional Use
Permit No. 86 --11 should substantiated complaints he received that the
church and school operation is creating parkin; problems or adversely
impacting the surrounding properties.
20. A minimum five -foot (5') wide landscaped planter shall be constructed
adjacent to the administrative office /chapel addition.
21. Utilities shall not be released until all conditions of approval have
been met to the satisfaction of the Planning Department.
22. One onsite fire hydrant shall be required, or equip the new parish hall
with an automatic sprinkler system.
23. The developer shall comply with the requirements of Title 19 California
Administrative Code for occupancy types.

Sanitary sewer connection fee (per Orange County Sanitation District
No. 3, Resolution No. 303).
Grading permit fee (per Section 7007 Uniform Building Code).
All applicable Building Department fees.
