Resolution No. 3066RESOLUTION NO. 3066 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 84 -17 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct two additional apartment units within a previously approved 30 -unit apartment project located at 8601 Walker Street. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended as an area for the development of medium density apartments, condominiums, townhouses or other group dwellings with provisions for adequate light, air, open space and landscaped area at maximum densities of 15.0 dwelling units per acre. Only those additional uses are permitted that are complimentary to, and can exist in harmony with, such residential developments. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The construction of the two new additional units will increase the community's affordable housing supply and aid the City in meeting its Housing Assistance Plan (HAP) goals. (2) The proposed site plan will provide adequate parking and landscape treatment as required by the City's Zoning Ordinance. (3) The proposed project will result in a significant upgrade of the existing property by providing 32 new residential units, replacing an older existing single - family residence. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." All requirements of the Orange County Fire Marshall's Office shall he complied with prior to a Certificate of Occupancy being issued. 2. The developer shall not erect or display on the subject property any signs which have not been approved in writing by the Planning Department. 3. All roof mounted equipment, such as heating and air conditioning units, shall he adequately screened from public view subject to the approval of City staff. 4. The final exterior color scheme shall be submitted to City staff for review and approval prior to actually painting the structure. S. All applicable conditions of Conditional Use Permit No. 84 -17 shall be complied with prior to occupancy of the subject building. 6. Onsite security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic. 7. Architectural elevations and site plans shall he reviewed and approved by the Planning Department prior to Building Department plan check submittal. 8. All architectural treatments and recreational amenities shall be con - structed as illustrated on plans and renderings submitted. The final exterior color scheme shall be submitted to City staff for review and approval prior to actually painting the structure. J. All requirements of the Orange County Fire Marshall's Office, Cypress Building and Safety Department, and Cypress Planning Department shall be satisfied prior to occupancy of the site. 10. The applicant /developer shall comply with all provisions of the City Code. 11 The applicant shall submit detailed plans including elevations for the cabana and laundry room to the Planning Department for approval prior to Building Department plan check sr'bmittal. The structure shall match the architectural style of the apartment buildings. 12. Balconies shall not exceed six feet (6') in width with one dimension. 13. The twelve parking stalls and carports closest to the west wall of Building IV shall he moved four feet (4') south. 14.
