A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 86 -20 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of
the City of Cypress to construct a parking lot facility which is more than
300 feet from the building it will serve at 10775 Business Center Drive.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is:
To provide for the classification and development of
parcels of land as coordinated, comprehensive projects
so as to take advantage of the superior environment
which can result from large -scale community planning.
To allow diversification of land uses as they relate
to each other in a physical and environmental arrange-
ment, while insuring substantial compliance with the
provisions of this Ordinance.
To provide for a zone encompassing various types of
land uses, such as single- family residential develop-
ments, multiple housing developments, professional and
administrative office areas, commercial centers,
industrial parks or any public or semi - public use or
combination of uses through the adoption of a Develop-
ment Plan and text materials which set forth land use
relationships and development standards.
b. The proposed location of the conditional use and the con-
ditions under which it would be operated or maintained will not be
detrimental to the public health, safety or welfare or be materi-
ally injurious to properties or improvements in the vicinity in that:
(1) The subject site will be sufficiently landscaped
to make it consistent with surrounding properties.
(2) Pedestrian traffic has been regulated through the
required construction of sidewalks in the vicinity
of the parking lot.
(3) The proposed parking lot will provide parking
support for existing buildings and will not
result in construction of new buildings.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 14th flay of July 1986.

CONDITIONAL USE PERMIT NO. 86 -20
1. The developer shall conform to all applicable provisions of the City Code.
2. Drainage shall be solved to the satisfaction of the City Engineer. A
grading plan signed by a registered California civil engineer and using
actual grades from an Orange County surveyor's benchmark shall be sub-
mitted for approval. In parking areas, AC shall have a minimum slope
gradient of two percent (2 %), and concrete shall have a minimum slope
gradient of two - tenths percent (.2 %).
3. A five -foot (5') wide PCC sidewalk shall be installed at back of curb for
access from the remote parking lot site to the building site, in the
following locations:
A. The east side of Business Center Drive from the Commerce Drive inter-
section to the Global Drive intersection.
B. The southeast corner of Business Center Drive and Commerce Drive.
C. The northwest corner of Business Center Drive and Global Drive, as
needed.
Five -foot (5') wide easements for the above sidewalks shall be dedicated
to the City. Connector walks shall be constructed from the above public
walks to access the two sites as approved by the City. A construction
plan shall be submitted for approval and permits issued to the contractor
prior to construction.
At the time of termination of the remote parking use, the developer shall
remove the above walks and restore the areas to be compatible with sur-
rounding improvements.
4. Wheelchair ramps shall be installed onsite and offsite in accordance with
State of California and City of Cypress Public Works Department standards.
5. The damaged cross gutter on Business Center Drive, south of Commerce Drive,
shall be removed and replaced as necessary to restore design flow line
grades. A street improvement plan shall be submitted for approval.
6. All existing public improvements at the development site which are damaged
due to construction, cracked, or otherwise below standard, shall be
removed and replaced to the satisfaction of the City Engineer.
7. The quantity, location width, and the type of driveways shall be subject
to the approval of the City Engineer. An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrances with local streets. No landscaping in excess of three feet (3')
high will be allowed in the area of the curb returns. Adequate sight
distance also shall be maintained within the development at all driveway
intersections to the satisfaction of the City Engineer.

8. Transportation Systems Management (TSM) measures shall be encouraged for
all developments in the Business Park. A transportation management action
plan is now being prepared by the City. The developer shall participate
in the TSM plan adopted by the City for the Business Park and shall partici-
pate in a Transportation Management Association (TMA) formed by landowners
in the Business Park with the assistance of the City and its consultants.
9. Street trees (15 gallon) forty feet (40') on center shall be installed in
back of the public sidewalk in conformance to the street tree policy of
the Public Works Department and shall be incorporated with the onsite
landscape plan. The type of trees shall be as required by the City's
street tree ordinance.
10. The developer shall comply with all requirements of the FAA should any
portion of the development encroach within the 100 to 1 imaginary surface
surrounding the Los Alamitos Air Base. Encroachment within the 50 to 1
approach surface will require approval by the FAA.
11. The developer shall not erect or display on the subject property any signs
which have not been approved in writing by the Planning Department.
12. Compact parking space aisles shall be denoted as such on the asphalt as
"Compact Only."
13. A detailed landscape and automatic irrigation plan shall be submitted to
the Planning Department for review and approval prior to issuance of a
grading permit and public works permit. In addition, a bond shall be
posted with the Public Works Department to guarantee against any defects
in plant materials and workmanship.
14. The applicant shall comply with all applicable conditions of Design Review
Committee No. 84 -11 and any amendments to Design Review Committee No. 84 -11.
15. A redwood landscape retainer, a minimum of two inches by six inches
(2" x 6 ") in size, shall be installed along all property lines where
necessary to retain the landscape planters until adjoining properties
are developed.
16. All requirements of the Orange County Fire Marshall's Office, Cypress
Building and Safety, Engineering and Planning Departments shall be
satisfied.
17. The applicant shall provide an Affidavit of Non - Severence recorded with
the Orange County Recorder's Office that runs with the land and shall be
in a form and substance acceptable to the City Attorney and Planning
Director prior to issuance of a grading permit and public works permit.

18 The developer's contractor shall provide the City with a Certificate of
Insurance on City form evidencing a comprehensive liability insurance
policy(s) with a combined single limit of not less than $500,000 each
occurrence in connection with the work performed. Certificate shall include
the City, its Council, officers, members of boards or commissions and
employees as additional Named Insureds with respect to all claims, actions,
damages, liabilities and expenses, including attorney's fees, arising out
of or in connection with the work to be performed under the development
executed by the Named Insured and City, including any act or omission of
employees, agents, subcontractors, or their employees. Such certificate
shall have a thirty (30) day cancellation notice to the City of Cypress.
19. Fees required for improvements are as follows:
. Engineering plan checking and inspection fee (per Resolution 1713).
. Grading permit fee (per Section 7007 Uniform Building Code).
. All applicable Building Department Fees.
20. The parking lot shall be redesigned to accommodate a minimum four -foot
(4') wide raised concrete walkway opening to link with the connector
walk providing access to the required sidewalk at the northwest corner
of the subject site.
21. The modification to Building "C" at 10775 Business Center Drive shall be
submitted for review and approval by City staff.
