A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
POSTPONING THE TERMINATION DATE OF CYPRESS LIGHTING
DISTRICT NO. 2
WHEREAS, by its Resolution No. 216, adopted December 18, 1961, this City
Council formed Cypress Lighting District No. 2 to provide for the operation and
maintenance of a street lighting system throughout the City; and
WHEREAS, said Cypress Lighting District No. 2 was formed for a period of 20
years commencing January 2, 1962, and terminating on January 1, 1982, and extended
for five years commencing January 1, 1982, and terminating on January 1, 1987; and
WHEREAS, this City Council wishes to postpone the termination date of Cypress
Lighting District No. 2,
NOW, THEREFORE, the City Council of the City of Cypress HEREBY DOES FIND, DETER-
MINE, RESOLVE AND ORDER as follows:
SECTION 1. There is good and sufficient reason for extending the termination
date of Cypress Lighting District No. 2 in that:
a. In the event Cypress Lighting District No. 2 expired, it would be
necessary for the City to commence proceedings for the formation of a new
lighting district to provide for the operation and maintenance of street
lighting throughout the City and this process would entail a substantial
expenditure of time and money which could otherwise be expended for necessary
City programs;
"ib. Cypress Lighting District No. 2 has been demonstrated to be a cost -
effective method of financing the costs of street lighting and has a history
of approximately 20 years of operation with virtually no protest from the
residents and taxpayers of the City; and
c. The citizens and taxpayers of the City have become accustomed to
and are familiar with the operations and procedures of Cypress Lighting
District No. 2, and the termination thereof would unnecessarily complicate
the City's ongoing street lighting programs.
SECTION 2. Pursuant to the authority of Streets and Highways Code Section
18062, the termination date of Cypress Lighting District No. 2 hereby is extended
from January 1, 1987, to January 1, 1992, said extension being a reasonable period
of time within which other methods of funding the costs of street lighting can be
thoroughly considered at both the state and local levels.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cypress on the 12th day of January 1987.
