Resolution No. 3154RESOLUTION NO. 3154 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 86 -21 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct a truck loading facility facing a street (Plaza Drive). The project is located at 10833 Valley View Street, the southwest corner of Plaza Drive and Valley View Street. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: To ensure responsible development of the proposed McDonnell Center- Cypress development while allow- ing for creative and imaginative community design concepts tailored to meet the needs of the particu- lar area. The Specific Plan, upon adoption, will serve both regulatory and planning functions and is intended to implement the City's General Plan by more precisely defining land uses, infrastructure, circulation patterns, development standards, and design guidelines. The Specific Plan establishes the necessary development controls to provide the City with the assurance that the completed project will be as envisioned at the time of approval. Since priorities for appropriate land uses are pre- determined, the Specific Plan also lessens the developer's uncertainty about whether or not a particular project will be permitted continuing development over the long term. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed project is consistent with the existing land uses in the immediate area. (2) The loading dock facility will be adequately screened from surrounding properties by the incorporation of a screening wall and exten- sive landscaping on the site. (3) The proposed project meets all objectives of the Cypress General Plan and Zoning Ordinance. (4) The location of the proposed truck loading dock is consistent with all of the criteria established for loading facilities facing public streets. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." The screen wall shall have an overall height of forty -two inches (42 ") and shall extend twenty (20) linear feet in length in an east -west direction. The adjacent planter (hedge entries) shall be fully land- scaped with dense screening plant materials. Species, spacing and number of trees shall be subject to approval by the Design Review Committee. 2. All applicable conditions of Design Review Committee No. 86 -21 shall be complied with prior to occupancy of the subject building. 3. The applicant shall submit structural drawings and applicable calcu- lations to the Building Department for plan check prior to fabrication. 4. Required footing for the forty -two inch (42 ") wall shall be sized and reinforced so that it may be extended to a total height of ninety -six inches (96 "). 5. A cash bond shall be posted with the City for a period of one (1) year from the date of occupancy, to provide for raising of the wall to ninety -six inches (96 ") in height and extending said wall at its ninety -six inch (96 ") height for an additional twenty feet (20') in the cast -west direction. Costs of restoring the landscaping after revising the wall shall be included in the bond. The bond estimate is to be approved by the City of Cypress prior to posting. A determination regarding the treed for a wall extension shall be made by the Design Review Committee upon receipt of substantiated information regarding a large increase in the number and /or size of the trucks utilising the truck dock.
