Resolution No. 3165437 RESOLUTION NO. 3165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS REPEALING ORDINANCE NO. 765 (ZONE CHANGE NO. 86 -1) A ZONING ORDINANCE OF THE CITY OF CYPRESS, AND CONFIRMING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY AS PS (PUBLIC AND SEMI - PUBLIC). WHEREAS, after a duly noticed public hearing on August 11, 1986 and after regular meetings of the City Council of the City of Sypress on September 22, 1986 and October 14, 1986 where evidence was presented and considered by the Council and first reading and second reading of Ordinance No. 765 (Zone Change 86 -1) were had; and WHEREAS, Ordinance No. 765 (Zone Change 86 -1) was adopted and ordered posted by a 3 to 2 vote of the City Council on October 14, 1986; and WHEREAS, during the thirty (30) days following said adoption of Ordinance No. 765 (Zone Change 86 -1) and before the effective date of said ordinance a referendum petition against said ordinance was filed with the City Clerk of the City of Cypress; and WHEREAS, the City Clerk has completed the verification and certification of said referendum petition, has determined that said petition is sufficient, has notified the proponents of said petition of such sufficiency, and has certified the results of said petition to this City Council at a regular meeting of the Council on November 24, 1986, all as required by the Elections Code, and other applicable laws; and WHEREAS, at the regular meeting of the City Council on November 24, 1986, the Council considered the petition, testimony, and other evidence presented during its reconsideration of Ordinance No. 765 (Zone Change 86 -1) as required by Elections Code Section 4050, 4051, et sect. and after due reconsideration it is the desire of said Council to entirely repeal the subject Ordinance 765 (Zone Change 86 -1). NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The referendum petition is declared sufficient and the City Council exercises its legal right to reconsider Ordinance No. 765 (Zone change 86 -1); and SECTION 2. Ordinance No. 765 (Zone Change 86 -1) is entirely repealed, rescinded, and shall not in any respect become effective; and SECTION 3. All that certain property described in Exhibit "B" attached hereto and by this reference incorporated herein, continues its previously existing PS Public and Semi - Public zoning and the official Zoning Map of the City of Cypress shall not be changed to reflect Ordinance No. 765.
