Resolution No. 23218 RESOLUTION NO. 232 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF CYPRESS OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED AS THE "CRESCENT ANNEXATION" AND GIVING NOTICE OF THE TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CYPRESS: 1. That pursuant to the provisions of the Annexation of Uninhabited territory Act of 1939, a petition signed by the owner of more than fifty per cent (50 %) of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange was filed with the Council of the City of Cypress on February 14, 1962, at the hour of 10:30 o'clock a.m., and prior to the adoption of this resolution, requesting annexation of the herein- after described territory to said City. 2. That the property which the petitioner requests be annexed to the City of Cypress and which said City and its Council proposed to annex is situate in the County of Orange, State of California, hereby designated as the "Crescent Annexation" and described as follows: That portion of the Southwest Quarter of Section 8, Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, California, as per Map recorded in Book 51, Page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, and a portion of Tract No. 812, County of Orange, California, as per map recorded in Book 24, Page 30, of Miscellaneous Maps, in said County Recorder's Office, described as follows: Beginning at an angle point in the present boundary line of the Lawrence Annexation to the City of Cypress, County of Orange, State of California, as said boundary line was established by Ordinance No. 44 of said City of Cypress, said angle point being at the intersection of the south line of the Northeast Quarter of the Southwest Quarter of said Section 8 with the southerly line of the Orange County Flood Control District right of way as last mentioned southerly line is described in said Ordinance No. 44, said angle point being also on the southerly line of said Tract No. 812; thence along said south line of the Northeast Quarter of the Southwest Quarter, and along said boundary line of the City of Cypress, and along said southerly line of Tract No. 812 and its easterly prolongation North 89 °46'37" East 425.90 feet as per map filed in book 47, pages 7 and 8 of Records of Survey of said Orange County, to the west line of the East Half of the East Half of the Northeast Quarter of the Southwest Quarter of said Section 8; thence along said west line and continuing along said boundary line of the City of Cypress North 0 °02'49" East 1311.53 feet to a line parallel with and distant 15.00 feet southerly, measured at right angles, from the north line of the south Half of said Section 8; thence along said parallel line, and departing from said west line and from said boundary line of the City of Cypress, South 89 °26'55" West 330.27 feet to the easterly line of said Tract No. 812; thence along said easterly line South 0 °03'10" West 1247.79 feet to a point in the northwesterly line of the land described in deed recorded July 29, 1959 in Book 4817, Page 70, Official Records of said Orange County, said point being on a curve concave northwesterly and having a radius 19 of 1041.00 feet, a radial to said point bears South 31 °39'54" East; thence southwesterly along said curve and along said northwesterly line 95.46 feet through a central angle of 5 °15'15 "; thence continuing along said northwesterly line, on a line that is not tangent to said curve, South 37 °20'56" West 20.00 feet to the point of beginning. 3. That the County Boundary Commission of the County of Orange did, in session duly assembled on February 13, 1962, approve the proposed annexation boundaries of the "Crescent Annexation" as hereinbefore described and as submitted to the Commission by Petitioner. 4. That said proposed annexation territory is uninhabited as defined by the statute and is contiguous to the City of Cypress and is not a part of any other municipal corporation. 5. That proponent of said annexation has heretofore, to wit on February 1, 1962, filed a map of the proposed annexation area with the Registrar of Voters of the County of Orange as required by Section 35002 of the Government Code of the State of California. 6. That April 16, 1962, at the hour of 7:30 o'clock p.m. in the Council Chambers of the City Hall of the City of Cypress, County of Orange, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Cypress and having any objections to the annexation may appear before the Council of the City of Cypress and show cause why such uninhabited territory should not be so annexed to the City of Cypress. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. 7. The City Clerk of the City of Cypress is hereby authorized and directed to cause copy of this Resolution to be published or posted as required by Section 35311 of the Government Code of the State of California, said publication or posting to be completed at least twenty (20) days prior to the date set for the hearing. 8. In the event there is upon the land proposed to be annexed to said City a structural improvement owned, being acquired or leased by a County Fire Protection District, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such District, such notice to be sent not less than ten (10) days before the first public hear- ing upon such proposed annexation. 9. That the City Clerk of the City of Cypress shall not less than twenty (20) days before the first public hearing on the proposed annexation, cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated at the address on said assessment roll, or as known to said Clerk, and to any person who has filed his name and address and the description of the lands in which he has any interest, either legal or equitable, with said Clerk, all as provided in Section 35311 of the Government Code of the State of California. 10. That in the event any land within the territory proposed to be annexed is owned by the County of Orange, the said Clerk shall not less than twenty (20) days before the first public hearing on the proposed annexation cause written notice of such proposed annexation to be mailed to the Board of Supervisors of Orange County. 11. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law. 12. The City Clerk is directed to transmit copies of this Resolution to the governing Board of each school district which, in part or in whole, is included in the above described territory and which has made written request therefor, if any. 13.
