Resolution No. 24241 RESOLUTION NO. 242 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF CYPRESS OF UNINHABITED TERRITORY DESCRIBED HJREIN AND DESIGNATED AS THE "ROMBOUT ANNEXATION" AND GIVING NOTICE OF THE TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CYPRESS: 1. That pursuant to the provisions of the Annexation of Uninhabited territory Act of 1939, a petition signed by the owner of more than fifty per cent (50%) of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Cypress on March 13, 1962, at the hour of 3:30 o'clock P. M., and prior to the adoption of this resolution, requesting annexation of the hereinafter described territory to said City. 2. That the property which the petitioner requests be annexed to the City of Cypress and which said City and its Council proposed to annex is situate in the County of Orange, State of California, hereby designated as the "Rombout Annexation" and described as follows: A portion of Section 8, Township 4 South Range 11 West, San Bernadino Meridian, in the County of Orange, State of California, described as follows: Beginning at an angle point in the existing boundary line of the City of Cypress, said angle point created by the Lawrence Annexation (City Ordinance No. 44 Certified by State October 6, 1958) and being the intersection of the Common Boundary line between Los Angeles and Orange County per Case Map No. 300 on file in the office of the Surveyor of Orange County Per Section 3938 of the State Statutes of 1919, with the Southerly Right of Way Line of the Orange County Flood Control District Right of Way as described in deed recorded in Book 3632 page 36 of the Official Records of Orange County; Thence leaving said existing boundary line of the City of Cypress North 44 °- 34' -00" East 145 feet more or less along said Common Boundary Line to an angle point in said Common Boundary line more particularly described as County Corner No. 12; Thence North 0 °- 11' -10" East 3996.39 feet along said Common Boundary Line to an angle point in said Common Boundary Line more particularly described as County Corner No. 13; Thence South 89 °- 37' -10" East 95 feet more or less along said Common Boundary to the existing boundary line of the original incorporation of the City of Dairyland approved by the State October 26, 1955, said existing boundary line being a line parallel to and distant 50.00 feet northeasterly of the centerline of the Pacific Electric Railway Right of Way; Thence leaving said Common Boundary Line South 53 °- 47' -30" East 580 feet more or less along said parallel line and existing boundary line of the City of Dairyland, to a line parallel to and distant 850 feet Westerly, from the East Line of the Northeast Quarter (NEY4) of the Northwest Quarter (NWy4) of said Section 8; Resolution No. 242 42 Thence South 0 °- 11' -27" East 1067 feet more or less along said parallel line to the South Line of the Northeast Quarter (NE'/4) of the Northwest Quarter (NW3) of said Section 8; Thence North 88 °- 52' -08" East 190.00 feet more or less to the West Line of the East Half (EY2) of the Southeast Quarter (SEA) of the Northwest Quarter (NW' /4) of said Section 8; Thence South 0 °- 11' -27" Fast 1318.09 feet to the North right of way line of Crescent Avenue being a line parallel to and distant 20.00 feet northerly from the South Line of the Northwest Quarter (NW'i4) of said Section 8; Thence South 89 °- 12' -24" West 360.30 feet along said parallel line to the northerly prolongation of the west right of way line of Acacia Street (60.00 feet wide) Thence South 0 °- 11' -26" East 1406.40 feet along said northerly prolongation, right of way line, and the southerly prolongation of the west right of way line to the existing boundary line of the City of Cypress created by said Lawrence Annexation being the Southerly Right of Way Line of the Orange County Flood Control District Right of Way and described in deed recorded in Book 3632 page 36 of the Official Records of Orange County, and being a point on a non - tangent curve concave northerly and having a radius of 1050.00 feet, a radial line of said curve through said point having a bearing of South 10 °- 27' -25" East; Thence westerly 183.15 along said curve, said Right of Way Line, and existing boundary line through a central angle of 9 °- 59' -40" to a line tangent; Thence South 89 °- 32' -15" West 152.01 feet along said tangent, said Right of Way Line and existing boundary line, to a curve, tangent, concave southerly and having a radius of 950.00 feet; Thence westerly 70.06 feet along said curve, said Right of Way Line and existing boundary line through a central angle of 4 °- 13' -32" to the point of beginning. Comprising approximately 43.1 acres. 3. That the County Boundary Commission of the County of Orange did, in session duly assembled on February 13, 1962, approve the proposed annexation boundaries of the "Rombout Annexation" as hereinbefore described and as submitted to said Commission by Petitioner. 4. That said proposed annexation territory is uninhabited as defined by the statute and is contiguous to the City of Cypress and is not a part of any other municipal corporation. 5. That proponent of said annexation has heretofore, to -wit on March 19, 1962, filed a map of the proposed annexation area with the Registrar of Voters of the County of Orange as required by Section 35002 of the Government Code of the State of California. 43 6. That May 14, 1962, at the hour of 7:30 o'clock P. M.,in the Council Chambers of the City Hall of the City of Cypress, County of Orange, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Cypress and having any objections to the annexation may appear before the Council of the City of Cypress and show cause why such uninhabited territory should not be so annexed to the City of Cypress. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. 7. The City Clerk of the City of Cypress is hereby authorized and directed to cause copy of this Resolution to be published or posted as required by Section 35311 of the Government Code of the State of California, said publication or posting to be completed at least twenty (20) days prior to the date set for the hearing. 8. In the event there is upon the land proposed to be annexed to said City a structural improvement owned, being acquired or leased by a County Fire Protection District, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such District, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. That the City Clerk of the City of Cypress shall not less than twenty (20) days before the first public hearing on the proposed annexation, cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated at the address on said assessment roll, or as known to said Clerk, and to any person who has filed his name and address and the description of the lands in which he has any interest, either legal or equitable, with said Clerk, all as provided in Section 35311 of the Government Code of the State of California. 10. That in the event any land within the territory proposed to be annexed is owned by the County of Orange, the said Clerk shall not less than twenty (20) days before the first public hearing on the proposed annexation cause written notice of such proposed annexation to be mailed to the Board of Supervisors of Orange County. 11. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law. 12. The City Clerk is directed to transmit copies of this Resolution to the governing Board of each school district which, in part or in whole, is included in the above described territory and which has made written request therefor, if any. 13. The City Clerk shall certify to the adoption of this Resolution.
