Resolution No. 316RESOLUTION1 NO. 316 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF CYPRESS OF UNINHABITED TERRITORY DESCRIBED }HEREIN AND DESIGNATED AS THE "STINSON ANNEXATION" AND GIVING NOTICE OF THE TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CYPRESS: 1. That pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by the owner of more than fifty per cent (50 %) of the land in the hereinafter described territory by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Cypress on December 4, 1962, at the hour of 11 :00 o'clock A. I., and prior to the adoption of this resolution, requesting annexation of the hereinafter described territory to said City, 2, That the property which the petitioner requests be annexed to the City of Cypress and which said City and its Council proposed to annex is situate in the County of Orange, State of California, hereby designated as the "Stinson Annexation" and described as follows: That portion of the West One -Half of Section 8, Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, California, as per Map recorded in Book 51, Page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, and a portion of Tract No, 812, County of Orange, California, as per Map recorded in Book 24, Page 30 of Miscellaneous Maps, in said County Recorder's office, described as follows: Beginning at an angle point in the present boundary line of the Lawrence Annexation to the City of Cypress, County of Orange, State of California, as said boundary line was established by Ordinance No, 44 of said City of Cypress, said angle point being at the intersection of the south line of the Northeast Quarter of the Southwest Quarter of said Section 8 with the southerly right of way line of the Orange County Flood Control District as last mentioned southerly right of way line is described in said Ordinance No, 44, said angle point being also on the southerly line of said Tract No, 812, said angle point being also a point on a non - tangent curve concave northerly and having a radius of 1050.00 feet; thence southwesterly along last described city boundary and along last mentioned southerly right of way line and along last mentioned curve 278,83 feet more or less through a central angle of 15° 12' 52" more or less to a point on the southerly prolongation of the west right of way line of Acacia Street, 60 feet in width as shown on said Tract No. 812; thence leaving said city boundary as last described and along last mentioned southerly prolongation and along last mentioned westerly right of way line of Acacia Street and its northerly prolongation North 0° 11' 26" West 1406.40 feet, more or less, to the north right of way line of Crescent Avenue, being a line parallel with and distant 20,00 feet northerly, measured at right angles from the south line of the Northwest Quarter of said Section 8; thence along last mentioned north line North 89° 12' 24" East 360.30 feet, more or less, to the northerly prolongation of the east line of said Tract No, 812; thence along last mentioned northerly prolongation and along last mentioned east line South 0° 03' 10" West 1247.79 feet, more or less, to a point in the northwesterly line of the land described in deed recorded July 29, 1959 in Book 4817, Page 70 of Official Records of said Orange County, said point being on a curve concave northwesterly and having a radius of 1041,00 feet, a radial to said point bears South 31° 39' 54" East; thence southwesterly along said curve and along last mentioned northwesterly line 95.46 feet through a central angle of 5° 15' 15" to the point of beginning. Resolution No. 316 3. That the County Boundary Commission of the County of Orange did, in session duly assembled on March 12, 1962, approve the proposed annexation boundaries of the "Stinson Annexation" as hereinbefore described and as submitted to said Commission by Petitioner. 4. That said proposed annexation territory is uninhabited as defined by the statute and is contiguous to the City of Cypress and is not a part of any other municipal corporation, 5. That proponent of said annexation has heretofore, to -wit on December 3, 1962, filed a map of the proposed annexation area with the Registrar of Voters of the County of Orange as required by Section 35002 of the Government Code of the State of California. 6. That January 14, 1963, at the hour of 7 :30 o'clock P. M., in the Council Chambers of the City of Cypress, County of Orange, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Cypress and having any objections to the annexation may appear before the Council of the City of Cypress and show cause why such uninhabited territory should not be so annexed to the City of Cypress. The protest must he in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. 7. The City Clerk of the City of Cypress is hereby authorized and directed to cause copy of this Resolution to be published or posted as required by Section 35311 of the Government Code of the State of California, said publication or posting to be completed at least twenty (20) days prior to the date set for the hearing. 8. In the event there is upon the land proposed to be annexed to said City a structural improvement owned, being acquired or leased by a County Fire Protection District, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such District, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. That the City Clerk of the City of Cypress shall not less than twenty (20) days before the first public hearing on the proposed annexation, cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated at the address on said assessment roll, or as known to said Clerk, and to any person who has filed his name and address and the description of the lands in which he has any interest, either legal or equitable, with said Clerk, all as provided in Section 35311 of the Government Code of the State of California. 10. That in the event any land within the territory proposed to be annexed is owned by the County of Orange, the said Clerk shall not less than twenty (20) days before the first public hearing on the proposed annexation cause written notice of such proposed annexation to be mailed to the Board of Supervisors of Orange County. 11. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law. 12. The City Clerk is directed to transmit copies of this Resolution to the governing Board of each school district which, in part or in whole, is included in the above described territory and which has made written request therefor, if any. Resolution No. 316 13. The City Clerk shall certify to the adoption of this Resolution.
