A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, CONFIRMING THE REPORT OFTHE CITY ENGINEER OF SAID
CITY, DATED JUNE 10, 1963, PREPARED PURSUANT TO RESOLUTION NO. 362 OF
SAID COUNCIL AND REFERRED TO IN RESOLUTION NO. 374 OF SAID COUNCIL, AND
THE PLAN, SPECIFICATIONS, ESTIMATE, AND ASSESSMENTS CONTAINED IN SAID
REPORT: ORDERING THE INSTALLATION OF THE STREET LIGHTING SYSTEM TO BE
ANNEXED TO CYPRESS NO. 2 LIGHTING DISTRICT; ORDERING THE MAINTENANCE
OF AND THE FURNISHING OF ELECTRIC CURRENT TO LIGHT SAID STREET LIGHTING
SYSTEM; LEVYING THE AFOREMENTIONED ASSESSMENTS; AND FORMING THE LIGHTING
DISTRICT ANNEXATION REFERRED TO IN RESOLUTION OF INTENTION NO. 375 AND
RESOLUTION APPOINTING TIME AND PLACE FOR HEARINGS NO. 376, ALL IN
ACCORD WITH DIVISION 14, PART 1, STREETS AND HIGHWAYS CODE, STATE OF
CALIFORNIA, AS AMENDED, REFERRED TO AS THE "STREET LIGHTING ACT OF 1919 ".
WHEREAS, the City Council of the City of Cypress, did, in Resolution No. 362
of said Council pursuant to the provisions of Division 14, Part 1, Street and
Highways Code, State of California, as amended, hereinafter referred to as the
':'Street Lighting Act of 1919 ", require the City Engineer of said City to make
and file with the City Clerk of said City a report in writing presenting certain
matters relating to a proposed annexation to Cypress No. 2 Lighting District in
said City; and,
WHEREAS, the City Engineer of said City, pursuant to the requirements of
said Resolution No. 362, did make and, on the 10th day of June, 1963, file in
the office of the City Clerk of said City his report in writing responsive to
the requirements of Resolution No. 362 and as contemplated under the provisions
of the Street Lighting Act of 1919; and,
WHEREAS, the City Council did thereafter and, on the 10th day of June, 1963,
pass its Resolution of Intention No. 375, declaring its intention to order the
installation of, maintenance of, and furnishing of electrical current for
the lighting of a street lighting system and on certain public streets within
said City for a period of eighteen (18) years and three (3) months; and,
WHEREAS, said City Council did also, on said 10th day of June, 1963, in
its Resolution No. 376, fix and designate Monday, the 8th day of July, 1963
at the hour of 7:30 P. M., of said day as the time, and 9471 Walker, Street in
the City of Cypress, California, as the place, for hearing protests in reference
to the proposed improvement and assessment; and,
WHEREAS, at the time and place above stated for the hearing of protests
in reference to the proposed improvement and assessment said Council did
proceed to hold, and did hold, said hearings; and,
WHEREAS, at the time and place stated for hearing protests in reference
to the proposed improvement and assessments, no protests or objections were
filed or presented to said Council; and,
WHEREAS, said Council being fully advised in the premises, has now
acquired jurisdiction to proceed further;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, DOES RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS:
SECTION I: That said Council does hereby approve, confirm and adopt the
said report of the City Engineer of said City, dated the 10th day of June, 1963,
and does approve and confirm the assessment proposed for said improvement set
forth and referred to in said report, which said report is now on file in the
office of the City Clerk of said City, open to inspection, hereby referred to
and made a part hereof, and said City Council does hereby also confirm and adopt
the respective instruments therein as plan, specification, estimate, diagram, and
assessment, all of which, on file as aforesaid, are hereby incorporated herein
and made a part hereof.
SECTION II: That said Council does hereby order the said contemplated
improvement to be made in accordance with said plan and specifications therefor,
as adopted and approved, and that the period of eighteen (18) years and three
(3) months referred to in Resolution of Intention No. 375, shall be and the
same is hereby fixed and established as the eighteen (18) year three (3) month
period commencing on the 1st day of October, 1963, and ending on the 1st day
of January, 1982, both dates inclusive, as therein set forth; and said Council
does hereby levy said proposed assessment made to cover the costs and expenses
of said improvements upon the respective parcels of land in the assessment
district described in Resolution of Intention No. 375, and as fixed and
determined by said report of June 10, 1963, the proposed assessment filed
therewith, as aforesaid, in the office of the City Clerk of said City, said
assessment shall be for the first fiscal year of said eighteen (18) years and
three (3) months term above referred to, to wit: The fiscal year beginning
July 1, 1963, and ending June 30, 1964, both dates inclusive.
SECTION III: That the City Clerk of said City is hereby ordered to
transmit, or cause to be transmitted, to the County Auditor of the County of
Orange, State of California, as contemplated under the provisions of said
Street Lighting Act of 1919, the diagram and assessment upon which said levy
is based, and the County Tax Collector of said County (who is also the City
Tax Collector for said City) is hereby designated, requested, impowered,
authorized, instructed, ordered, and directed to make collection of all
assessments shown in said assessment and to perform the acts and duties as are
required by law of, and to be performed by, the officer, employee, or person
designated.
SECTION IV: That the City Clerk
of this Resolution and the same shall
APPROVED, PASSED AND ADOPTED this
shall certify to the passage and adoption
thereupon take effect and be in force.
