Resolution No. 278316 RESOLUTION NO. 2783 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADOPTING A NEW FEE SCHEDULE FOR ANIMAL SHELTER AND ANIMAL CONTROL SERVICES, EFFECTIVE JULY 1, 1984. WHEREAS, the City of Cypress contracts with the County of Orange for complete animal control services; and WHEREAS, the Human Services Agency conducted meetings with several Orange County cities to discuss the proposed fees as recommended by the Auditor -Controller's Office based on prior fiscal year costs and service volume; and WHEREAS, the revised Animal Control Fees were presented to the Orange County Board of Supervisors which adopted the new fee schedule at its meeting of May 8, 1984; and WHEREAS, in conformance with the provisions of the contract with Orange County, the City is required to adopt the same amendments within 120 days after notification by the County. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cypress does hereby adopt the new Fee Schedule for Animal Shelter and Animal Control Services, effective July 1, 1984, attached hereto as Exhibit A and by this reference incorporated herein. DEFINITIONS A. A large animal is any animal weighing 300 pounds or more. B. A medium animal is any animal weighing greater than 50 pounds, but less than 300 pounds. C. A dog or cat is any animal defined as such in County Ordinance No. 2836. D. An animal is as defined in County Ordinance No. 2836. E. A contract city 1s any municipality that has entered into a contract with the County of Orange for enforcement of Animal Control and Animal Shelter Services, or for either of such services. F. Actual Cost is the actual expense incurred by the County of Orange, including, but not limited to, salaries, employee benefits, overhead supplies, animal food, medication, contract services. G. A kennel means any property where four (4) or more dogs, or four (4) or more cats, over the age of four (4) months, are kept or maintained for any purpose except veterinary clinics and hospitals, and except property for which an animal permit has been issued pursuant to Section 4-1-76 of the Codified Ordinances of the County of Orange. H. A pet shop means any person or facility engaged in the sale or trade of live animals on a commercial basis. I. A grooming parlor means any premises where animals are groomed, brushed, clipped or bathed on a commercial basis. J. An animal rental establishment means a place or facility where animals other than dogs, cats, or equines are kept or maintained for hire. K. A permanent animal exhibition means any property where animals are exposed for public viewing for entertainment, instruction or advertise- ment, including animal acts, on a regular basis, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee, or donation is collected or solicited. L. A commercial stable means any property where equines are sheltered or fed on a commercial basis. M. A circus means a carnival, tent show or show in the open air, or in a hall or building not specifically constructed for theatrical purposes, wherein animals are exposed for public viewing for entertainment, instruction or advertisement. N. A rodeo means any activity or show in which equines or bovines are exposed for public view for entertainment, instruction or advertise- ment, excluding a permanent animal exhibition, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee, or donation is collected or solicited. 0. Impounded means having been received into the custody of the Health Officer of Orange County or his deputy. P. A temporary animal exhibition means any activity, or property used. for, the public viewing of animals for entertainment, instruction or advertisement, including animal acts, of less than a regular basis, excluding activities conducted primarily for the instruction or entertainment of persons for which no charge, fee or donation is collected or solicited. 17 18 Proposed Fee Schedule for Animal Shelter and Animal Control Services (Continued) II. FEE SCHEDULE A. For Animals Impounded at the Shelter 1. Impound Fees: MINIMUM a. Large animal (horse, cow, etc.) actual cost or $40.00 b. Medium animal (pig, sheep, etc.) actual cost or $30.00 c. Dog, cat, or other small animal actual cost or $25.00 (Except that animals that are impounded more than once within a twelve (12) month period will be charged above fees plus fifty percent (50%) of prior impounding charges.) 2. City Shelter Service Fees: Charged to contract cities for animals not redeemed by owners $13.00 3. Placement Fees: a. Dog $13.00 b. Cat $ 8.00 c. Other animal subject to placement Market Value 4. Daily Care and Feed: (Start with first day, Sundays and holidays included except no charge if redeemed same day, i.e., day of impound.) a. Large animal (horse, cow, etc.) $ 7.50 b. He/she may approve from County funds to practicing veterinarians rendering treatment to impounded animals. B. Individual Animal Licenses: Note 1. A dog license can be sold only for the period covered by a valid rabies vaccination certificate acceptable to the California Department of Health (Ca. Admin. Code 2606.4). Note 2. The reduced fee for a neutered animal will be allowed only upon presentation of a certificate of spaying, castration, or of the dog's inability to reproduce signed by a licensed veterinarian. Note 3. Any person who fails to purchase or renew a license within fifteen (15) days after it has become due or expired shall be deemed delinquent and may be required to pay a late fee of five dollars ($5.00) in addition to the prescribed fee. Note 4. Once purchased, there will be no refund of license fees unless it is demonstrated that, at the time the license became effective, the animal was not subject to licensing. 2 Proposed Fee Schedule For Animal Shelter and Animal Control Services (Continued) II.
