Resolution No. 2791RESOLUTION NO. 2791 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 84-14 - WITH CONDITIONS. 31 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESERVES, DETERMINES AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to operate a used auto sales business at an exist- ing auto repair shop on property located at 5431 Lincoln Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: To provide appropriately located areas for establish- ments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. b. The proposed location of the conditional use and the con- ditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materi- ally injurious to properties or improvements in the vicinity in that: (1) The proposed use will be a minor addition to the existing auto repair business and will not result in the expansion of any buildings or of the site itself. (2) The property will be upgraded to provide paved asphalt, parking and landscaping. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." Conditional Use Permit No. 84-14 shall expire one (1) year from the date of City Council approval, unless before expiration said use permit is extended by the City Council. 2. The developer shall conform to all applicable provisions of the City Code. 3. Drainage shall be solved to the satisfaction of the City Engineer. A grading plan shall be submitted for approval. If the existing natural flow of any adjoining parcel is across the land of this development, a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer. In parking areas, AC shall have a minimum slope gradient of two percent (2%), and concrete shall have a minimum slope gradient of two-tenths percent (.2%). 4. The landscaping in the parkway on Electric Street, including owner's arrangement with Southern California Water Company to adjust water valve to grade if necessary, shall be improved to the satisfaction of City staff. The parkway landscaping shall be maintained by the , developer. 5. Onsite security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic. All roof mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view, subject to the approval of the City staff. 6. All automotive repair and product and material storage shall occur within the buildings. Exterior repair and storage is specifically prohibited. 7. Any existing nonconforming signs must be removed from the site and a uniform signage program shall be submitted to the Planning Department for review and approval prior to the installation of any new signage. 8. The existing dirt areas north and west of the building shall be paved with asphaltic concrete per City standards. Parking layout shall be approved by the City and striped. This should be accomplished within one hundred and eighty (180) days from City Council approval. 9. Fees required for improvements: a. All applicable Building Department fees. 10. The applicant shall submit a revised site plan showing the required changes, including landscape planters, parking spaces, fence relocation, and any other changes as per City Council direction. 11. Barbed wire on perimeter fence is to be removed. 33 EXHIBIT "B" CONDITIONAL USE PERMIT NO. 84-14 1. The applicant shall provide a three and one-half foot (31/2') deep land- scaped planter along the full width of the Electric Street property line, excepting the driveway access/egress point. A landscape and irrigation plan shall be submitted for approval by the City and a bond posted by the applicant to guarantee against any defects in plant materials and workmanship. A soils report for all planting areas, by a qualified agricultural laboratory, shall be submitted to the Public Works Department for approval at least thirty (30) days prior to planting date. Test results shall include concentration of nitrogen, phosphorus, potassium, pH, salinity, sodium status, and boron saturation extract. 3. A wheelchair ramp shall be installed at the northeast corner of Electric Street and Lincoln Avenue per City standards. 4. A11 secondary and primary utility services shall be underground. 5. Allexisting public improvements at the development site which are damaged, cracked, or otherwise below standard, shall be removed and replaced to the satisfaction of the City Engineer. 6. The applicant shall remove the chain link fence along the Lincoln Avenue and Electric Street frontages and replace it with a three-foot (3') high solid block/brick wall or single chain strand. At the applicant's request, a portion of the parking area could be chain link fenced to provide security, subject to City staff approval. In addition, all barbed wire fencing shall be removed from the site. 7. Fees required for improvements: a. The drainage fee of $1,754.30 for Master Drainage Plan (per Resolution 2287) shall be paid.
