A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE
PERMIT NO. 83-19 - WITH CONDITIONS.
THE. CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:

1. That an Application was filed for an amendment to a conditional
use permit in accordance with the provisions of Section 17.2 of the Zoning
Ordinance of the City of Cypress to convert a recreation room into an
apartment unit while implementing a one unit density bonus allowance as
provided for by the State of California, on property generally located at
5582 Crescent Avenue.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the amendment to conditional use is
in accord with the objectives of the Zoning Ordinance and the purpose
of the zone in which the site is located is:
Intended as an area for the development of medium
density apartments, condominiums, townhouses or
other group dwellings with provisions for adequate
light, air, open space and landscaped area at
maximum densities of 15.0 dwelling units per acre.
Only those additional uses are permitted that are
complimentary to, and can exist in harmony with,
such residential developments.
b. The proposed location of the amendment to conditional use and
the conditions under which it would be operated or maintained will
not be detrimental to the public health, safety or welfare or be
materially injurious to properties or improvements in the vicinity
in that:
(1) The construction of the new unit will increase
the community's affordable housing supply and
aid the City in meeting its Housing Assistance
Plan goals.
(2) With the additional unit the project will still
meet all open space landscaping and setback
requirements of the Cypress Zoning Ordinance.
(3) The applicant will provide new parking for the
additional unit in order to meet the Cypress
Zoning Ordinance requirements for parking.
c. The proposed amendment to conditional use will comply with
each of the applicable provisions of the Zoning Ordinance except
for approved variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit. "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 23rd day of July 1984.

AMENDMENT TO CONDITIONAL USE PERMIT NO. 83-19
1. Alloriginal conditions of approval of Conditional Use Permit
No. 83-19 shall remain in effect and be complied with.
2. The developer shall enter into an agreement with the City which
willassure the City that twenty-five percent (25%) of the total
units of this project will be rented to persons and families of
low and moderate income as defined by the County of Orange and
Section 50093 of the Health and Safety Code. Said agreement
shall be acceptable to the City Attorney's office, the Planning
Department, and the developer. Said agreement shall be
executed prior to the issuance of building permits for the
first units of the first phase of the suhject project.
