Resolution No. 2837105 RESOLUTION NO. 2837 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING PARCEL MAP NO. 84-1176 - WITH CONDITIONS. WHEREAS, an application was made by Cypress Land Company to allow the division of one parcel into seven lots and create a 45' wide street generally located on the east side of Dana Way and Darwin Way in PC -2 Planned Community Commercial/Light Industrial Zone. WHEREAS, the City Council considered evidence presented by the Applicant, City staff and other interested parties at a public meeting held with respect thereto. NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows: 1. The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The proposed subdivision conforms with the Land Use Element of the City's General Plan, the Cypress Corporate Center Master Plan and the present regulations according to the PC -2 Zone for which this property is presently zoned. b. All required public and/or private roadways conform with the minimal roadway dimensions as outlined in the City's Circulation Element of the General Plan. c. Noise insulation standards will be enforced on all proposed buildings in order to ensure that the proposed development conforms with the City's Noise Element of the General Plan. 2. The design and improvements of the proposed subdivision as designated on the parcel map and supplemented by the condition, and incorporated herein by reference, is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The subject property shall be improved in conformance with present zoning and all applicable ordinances in effect at the time this map is recorded with the County of Orange. All necessary utility services will be provided to the property in conformance with the Cypress Municipal Code. b. The subdivision will offer for dedication public roadways which conform with Specific Plan No. 81-1 as previously reviewed and approved by the City Council, and Amendment to Specific Plan No. 81-1. 3. None of the findings set forth in Government Code Section 66474 can be made. 4. The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing require- ments prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq.). Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative subdivision map, although such denial is not mandatory. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Parcel Map No. 84-1176, subject to the conditions attached hereto as Exhibit "A." 106 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 24th day of September 1984. Public Right of Way on the proposed private street east of the intersection of Dana Way shall be 45 feet in width. This intersection shall be a standard "Tee" intersection with the north east property line radius being 27 feet. The developer shall obtain an easement forroadway purposes from property owner to the west in order for the curb and gutter on the south side of the street at the intersection to be continuous. The above easement shall be obtained prior to permits being issued. 2. The developer shall conform to all applicable provisions of the City Code. All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied. 3. The final subdivision map filing fee shall be paid. 4. An Amendment to the Traffic Study conducted for the Cypress Corporate Center Master Plan, 1981 shall be required. The amended study shall address the following: a) Change of Dana/Darin Way to cul-de-sac (was originally shown on the Master Plan Traffic Study as connecting thru to Holder Street). b) Impact of existing and ultimate traffic (including trucks) on Katella/ Dana intersection and on Dana and Darin Way resulting from development of this remaining parcel of land. Existing and future traffic counts and warrants to be included. c) Respond to City's recommendation for no future signal installation at the Katella/Dana intersection. The original Master Plan Traffic Study mitigating measure concerning the signal at Dana/Katella must be amended.
