RESOLUTION NO. 2746
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
REPEALING RESOLUTION NO. 1584 AND ADOPTING AMENDED
GUIDELINES FOR IMPLEMENTATION OF THE CALIFORNIA ENVIRON-
MENTAL QUALITY ACT.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY RESOLVES
AS FOLLOWS:
WHEREAS, pursuant to Resolution No. 1584 entitled, "A
Resolution of the City Council of the City of Cypress Repealing
Resolution No. 1442 and Adopting New Objectives, Criteria and
Procedures Implementing the California Environmental Quality
Act", the City Council previously adopted local procedures to
implement the California Environmental Quality Act of 1970
("CEQA") consistent with the "Guidelines for the Implementation
of the California Environmental Quality Act of 1970" (the "Old
Guidelines"); and
WHEREAS, subsequent to the adoption of Resolution 1584, the
Resources Agency of California extensively revised the Old
Guidelines to reflect changes in statutory and common law
regarding CEQA, which have been renamed the "Guidelines For
Implementation of The California Environmental Quality Act"
(the "New Guidelines"); and
WHEREAS, Section 15022 of Chapter 3, Division 6, Title 14
of the California Administrative Code requires that each public
agency adopt objectives, criteria, and specific procedures
consistent with both CEQA and the New Guidelines,and authorizes
each public agency, in meeting such requirements, to adopt the
New Guidelines through incorporation by reference.
NOW, THEREFORE,BE IT RESOLVED that:
1. Resolution No. 1584 adopted by the City Council on the
14th day of April 1975, is hereby repealed in its entirety.
2. The City Council hereby adopts the New Guidelines and
incorporates such by reference, together with any amendments to
the New Guidelines hereafter made; provided, however, Section
15072 thereof, entitled "Public Notice", shall read as follows:
"(a) Notice that the lead agency proposes to adopt a
negative declaration shall be provided to the public
at least ten (10) days prior to adoption by the lead
agency of the negative declaration. The notice shall
state that a negative declaration with respect to the
subject project will be filed with the Clerk of the
County of Orange on a specified date which shall be no
sooner than ten (10) days following the date of the
notice. Copies of the notice (together with copies of
the initial study and the proposed negative declaration)
shall be given to all organizations and individuals who
previously requested such notice and shall also be
given by at least one of the following procedures:
(1) Publication at least one time by the lead agency
in a newspaper of general circulation in the area
affected by the proposed project.
(2) Posting of notice by the lead agency on and off
site in the area where the project is to be
located.

Direct mailing to owners of property contiguous
to the project as such owners are shown on the
equalized assessment roll.
(b) The alternatives for providing notice specified in
subsection (a).shall not preclude the lead agency from
providing additional notice by other means if the
agency so desires, nor shall the requirements of this
section preclude the lead agency from providing the
public notice at the same time and in the same manner
as public notice required by any other laws for the
project."
PASSED AND ADOPTED by the City Council of the City of Cypress
at a regular meeting held on the 14th day of February 1984.
