Resolution No. 27711-48 RESOLUTION NO. 2771 A RESOLUTION OF THE CITY COUNCIL OF TIIE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 84-8 WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to allow the onsite sale of general alcoholic beverages (beer and wine only) at the Pizza Pub and Grub Restaurant at 5591 Lincoln Avenue, in the CII -10,000 Commercial Heavy Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zones in which the site is located is: To provide appropriately located areas for establish- ments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) This use is allowed subject to a conditional use permit in the CH Commercial Heavy Zone. (2) Adequate onsite patron parking is provided on the existing site. (3) The business will not be detrimental to the com- munity since the City' Council reserves the right to restrict the hours of operation. (4) The granting of this conditional use permit will improve the property in that certain landscaping and site improvements are required as part of the conditional use permit approval. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to conditions attached hereto as Exhibit "A." USE PERMIT NO. 84-8 1. The applicant shall satisfy all necessary requirements of the State Department of Alcoholic Beverage Control prior to Conditional Use Permit No. 84-8 becoming effective. 2. Developer shall conform to all applicable provisions of the City Code. The public sidewalk in front of the restaurant shall be repaired as follows: After the street tree is removed by the City, an approximate twenty -foot (20') by twelve -foot (12') arca of sidewalk shall be removed and replaced. b. The other empty treewell shall be filled with concrete. c. The sidewalk around the railroad signal shall be repaired to the satisfaction of the City Engineer. The above shall be done un a public works excavation permit. 4. An eighteen -inch (18") by eighteen -inch (18") "Do Not Enter" sign shall be installed at the east drive approach per City standards. 5. Drainage fee shall be paid per Resolution 2287. 6. All nonconforming signs shall be removed and new sign plans must be submitted and approved by City staff prior to any new sign installation. 7. The parking lot shall he re -striped according to the City Engineer's satisfaction. S. The landscape planter boxes along Lincoln Avenue shall be re -landscaped with new plant material as approved by City staff. 9. Offsite sale of alcoholic beverages shall not be permitted unless it is agreed by the Council subsequent to its consideration of the impending report by the staff regarding the proliferation of liquor licenses in the City of Cypress that the granting of permission for such sales is not detrimental to the public health, safety and welfare.
