RESOLUTION NO. 2864
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING TENTATIVE TRACT MAP NO. 12313 - WITH CONDITIONS
WHEREAS, an application was made by the J. M. Peters Company, Inc. to
divide eight parcels into 66 parcels for the development of single family
residences located at the southwest corner of Orange Avenue and Denni Street,
on 12.55 acres.
WHEREAS, the City Council considered evidence presented by the appli-
cant, City staff and other interested parties at a public meeting held with
respect thereto.
NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY
RESOLVE as follows:
1. The proposed map is compatible with the objectives, policies,
general land uses and programs specified in the General Plan of the City of
Cypress in that:
a. The density of the development is in accordance with the
objectives and standards established by the Land Use
Element of the General Plan.
b. The subdivision of the property will provide for the improve-
ment of Orange Avenue in accordance with the Circulation
Element of the General Plan.
c. The proposed development being implemented through this map
will improve the housing stock of the City in accordance
with the general guidelines set forth in the Housing Element.
2. The design and improvement of the proposed subdivision as designated
on the tentative tract map and supplemented by the conditions attached hereto
as Exhibit "A," and incorporated herein by reference, are compatible with the
objectives, policies, general land uses and programs specified in the General
Plan of the City of Cypress in that:
a. The subdivision will facilitate the development of a project
and the improvement of a parcel of land which will be compati-
ble with adjacent land uses, will provide added housing for
existing and future residents of the City and will provide
for overall improvements to the surrounding neighborhood.
3. None of the findings set forth in Government Code Section 66474
can be made.
4. The discharge of waste from the proposed subdivision into the exist-
ing community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control
Board having jurisdiction over the proposed subdivision pursuant to the pro-
visions of Division 7 of the California Water Code (Sections 13000 et seq.).
Denial of a subdivision for violation of the proposed waste discharge
standards or an addition to an existing violation thereof, is a ground for
denial of the tentative subdivision map, although such denial is not manda-
tory.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Tract Map No. 12313 subject to the
conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 28th day of January 1985.

TENTATIVE TRACT MAP NO. 12313
1. The developer shall conform to all applicable provisions of the City Code.
All requirements of the State Subdivision Map Act, and the City's Subdi-
vision Ordinance and Zoning Ordinance shall be satisfied.
All vehicular access rights to Orange Avenue and Denni Street except at
street intersection shall be dedicated to the City.
2. Drainage shall be solved to the satisfaction of the City Engineer. A
grading plan, in ink on Mylar, signed by a registered California civil
engineer and using actual grades from an Orange County surveyor's bench-
mark shall be submitted for approval. A topograph of the area surround-
ing this development shall be made to establish existing drainage flow
patterns. If the existing natural flow of any adjoining parcel is across
the land of this development, a drainage easement shall be granted and
drainage facilities provided for that property to the satisfaction of the
City Engineer. All lots shall have a slope gradient of one percent (1%)
minimum from rear lot line to the street. In parking areas, AC shall have
a minimum slope gradient of two percent (2%), and concrete shall have a
minimum slope gradient of two-tenths percent (.2%).
3. A minimum six-foot (6') high block wall, measured from the highest adja-
cent grade, shall be constructed and/or maintained along the north, south,
east and west property lines. A retaining wall per City standards shall
be constructed at the property line where the grade difference is greater
than twelve inches (12").
4. Wheelchair and handicapped access facilities shall be installed onsite and
offsite in accordance with State of California and City of Cypress Public
Works Department standards.
5. Installation of Cable T.V. shall be subject to City Ordinance No. 726.
Prior to construction, the developer shall contact Copley/Colony, Inc.
(Phone: [714] 545-8071) for specifications and procedures for the
prewire of the building and installation of the service wiring. Neces-
sary permits shall be obtained at the City.
6. The developer shall provide mailbox facilities for each residence, to
the satisfaction of the Public Works Director, Planning Director, and
Postmaster.
7. All existing public improvements at the development site which are
damaged due to construction, cracked, or otherwise below standard, shall
be removed and replaced to the satisfaction of the City Engineer.

8. Interior streets shall be dedicated and fully improved with curb, gutter,
sidewalk, driveway, paving, utilities, etc., in accordance with the City's
Master Plan of Streets. Interior local streets shall have a total
right-of-way width of fifty-two feet (52'), and interior cul-de-sac
streets shall have a total right-of-way of forty-eight feet (48') with an
additional six-foot (6') wide tree planting, and public utility easement
on each side of the street. Cul-de-sac streets shall have a minimum curb
line radius of thirty-eight feet (38'). Curb returns at the intersection
of arterial and local streets shall have a radius of thirty-five feet (35')
and curb returns at the intersection of interior streets shall have a
radius of twenty-five feet (25'). All corner cutoffs shall be dedicated
to the City of Cypress for roadway purposes.
The south side of Orange Avenue shall be dedicated to the ultimate width
of forty-two feet (42') with a half street curb width of thirty-two feet
(32'), and shall be fully improved with the curb, gutter, sidewalk,
paving, etc., in accordance with the City's Master Plan of Streets.
Denni Street shall be improved with a variable thickness asphalt concrete
cap in order to obtain a minimum cross fall of two percent (2%).
Developer shall be responsible for necessary sandblasting of street
striping on Orange Avenue and Denni Street.
9. Proposed street names for newly created streets shall be subject to the
approval of City staff. The developer shall submit to the City a list of
three (3) proposed names for each new street and the City shall choose
the most appropriate name, either from this list or as recommended by
City staff. New streets that align with existing streets shall use the
existing street name.
10. On local streets, structural sections shall be based on the recommendation
and soils report prepared by an engineering firm acceptable to the City
Engineer, with street structural sections to be determined by using an
applicable T.I. (Traffic Index) but shall be not less than than three-inch
(3") A.C. over six-inch (6") A.B. The City shall provide the soils report
for all arterial streets. The minimum flowline grade in streets shall
be two-tenths percent (.2%).
11. The quantity, location width, and the type of driveways shall be subject
to the approval of the City Engineer.
12. All secondary and primary utility services shall be underground. Trench-
ing and backfill in streets shall be per City of Cypress Standard No. 110.
Arterials shall be crossed by boring only. In City streets lateral open
cuts spaced within twenty feet (20') of each other shall be covered with
a one inch (1") continuous A.C. cap.
13. Developer shall conform to all conditions recommended by the Traffic
Commission.
14. Street lights shall be installed on interior streets, Orange Avenue and
Denni Street, per City and Edison Company standards. Street name signs
and traffic signs shall be installed per City standrds.

15. Street trees (15 gallon) forty feet (40') on center shall be installed
on interior streets, Orange Avenue and Denni Street in conformance to
the street tree policy of the Public Works Department. The type of trees
shall be as required by the City's Department of Public Works.
16. A sewer plan shall be submitted for approval by the City Engineer, with
plan check and inspection by the City's Engineering Division. Sewer
laterals connecting existing houses at this property shall be plugged at
the property line.
17. A landscape and irrigation plan for Denni Street and Orange Avenue
parkways shall be submitted for approval by the City and a bond posted
by the applicant to guarantee against any defects in plant materials and
workmanship. A soils report for all planting areas, by a qualified
agricultural laboratory, shall be submitted to the Public Works Depart-
ment for approval at least thirty (30) days prior to planting date. Test
results shall include concentration of nitrogen, phosphorus, potassium,
pH, salinity, sodium status, and boron saturation extract.
18. The developer shall provide the City with a Certificate of Insurance on
City form evidencing a comprehensive liability insurance policy(s) with
a combined single limit of not less than $500,000 each occurrence in
connection with the work performed. Certificate shall include the City,
its Council, officers, members of boards or commissions and employees as
additional Named Insureds with respect to all claims, actions, damages,
liabilities and expenses, including attorney's fees, arising out of or in
connection with the work to be performed under the development executed
by the Named Insured and City, including any act or omission of employees,
agents, subcontractors, or their employees. Such certificate shall have
a thirty (30) day cancellation notice to the City of Cypress.
19. Prior to the recordation of a final map, water improvement plans shall be
approved by the Fire Marshall for fire protection and financial security
posted for the installation. The adequacy and reliability of water
system design, location of valves, and the distribution of fire hydrants
will be evaluated in accordance with Insurance Services Office suggested
standards contained in the "Grading Schedule for Municipal Fire Protection."
20. Prior to the completion of an application for building permits for com-
bustible construction, evidence that a water supply for fire protection
is available shall be submitted to the County Fire Marshall.
21. Prior to issuance of building permits, plot plans and elevations shall
be submitted for all proposed units, in accordance with the Design Review
provisions of the Zoning Ordinance.
22. All lots within the subdivision shall contain minimum areas of 6,000 square
feet.
