RESOLUTION NO. 662
A RESOLUTION OF THE CITY OF CYPRESS RESCINDING
RESOLTUION NO. 654 AND FORMING A JOINT POWERS AGREE-
MENT BETWEEN THE CITY OF CYPRESS AND THE ANAHEIM
UNION HIGH SCHOOL DISTRICT TO PROVIDE FOR DRAINAGE
FOR AREAS LOCATED ON CERRITOS AVENUE EAST OF BLOOMFIELD
WHEREAS, the City of Cypress caused to be installed certain drainage
facilities in District 3-B which have been paid for by the persons who have
participated in the development of the property; and
WHEREAS, the zoning plan adopted by the City has deviated somewhat from
the proposed general plan; and
WHEREAS, the development which has occurred in District 3-B is somewhat
different from that anticipated by the proposed general plan of the City of
Cypress and has reduce the amount of anticipated run-off in the drainage
district; and
WHEREAS, the facilities which had been constructed have some excess
capacity for the necessary run-off; and
WHEREAS, it is possible to use a portion of this excess capacity for
facilities to be constructed by the Anaheim Union High School District; and
WHEREAS, it is the desire of the City to providenoney as rapidly as
possible for those who have advanced monies and are awaiting reimbursement
for facilities which they have constructed; and
WHEREAS, it is the desire of the Anaheim Union High School District and
the City of Cypress to reduce the expenses for the school construction;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress
that the Mayor be authorized to sign, and City Clerk to attest, an agreement
between the City of Cypress and the Anaheim Union High School District as
follows:
a. The City grants to the Anaheim Union High School District the
capacity rights in its drainage facilities in Drainage Distritt 3-B
sufficient to drain 2.813 acres of its school site located at the
southeast corner of Bloomfield and Cerritos,more particularly described
below as:
A portion of the westerly 800.00 feet of the North half of the Southwest
Quarter of Section 20, Township 4 South, Range 11 West, S.B. & M. in the
City of Los Alamitos, County of Orange, State of California, described
as follows:
Commencing at a point, which is the intersection of the westerly line of
Section 20, Township 4 South, Range 11 West and the north line of the
Southwest Quarter of Section 20 and which point is also the centerline
intersection of Cerritos Avenue and Bloomfield Street; thence along said
centerline of Cerritos Avenue South 89° 48' 00" East 800.00 feet; thence
South 0° 12' 00" West 50.00 feet to the southerly right of way line of
Cerritos Avenue 100 feet wide, said point also being the True Point of
Beginning of this description; thence South 34° 53' 43" West 158.11 feet;
thence North 89° 48' 00" West parallel with said centerline of Cerritos
Avenue 590.00 feet; thence North 37° 38" 11" West 130.42 feet; thence
North 45° 12' 00" East 38.18 feet to said southerly right of way line;
thence South 89° 48' 00" East along said southerly right of way line 733.00
feet to the True Point of Beginning
b. The Anaheim Union High School District agrees to Fey to the City an
amount of $2,672.35 for such capacity rights.
BE IT FURTHER RESOLVED, that Resolution No. 654, of the City of Cypress,
adopted on December 13, 1965, is hereby rescinded.
