A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN
REAL PROPERTY IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA,
AND DECLARING THE PUBLIC NECESSITY THEREFOR.
WHEREAS, the City of Cypress is authorized, by virtue of the
Statutes of the State of California, to take property by condemnation
and hold, use and enjoy said property as necessary to the full exercise
of its power;
NOW, THEREFORE, the City Council of the City of Cypress does
hereby resolve as follows:
Section 1. That the City Council of the City of Cypress has
found and determined and does hereby find and determine that the public
interest and necessity require for public use the acquisition, con-
struction, completion, operation and maintenance by said City of Cypress
of certain public improvements, to wit: street right of way purposes
in fee simple absolute, and that certain real property situated in the
City of Cypress, County of Orange, State of California, is necessary
therefor.
Section 2. That the real property, the acquisition of which is
required for the public interest and necessity for the uses and purposes
set forth in Section 1 hereof, is situated in the City of Cypress,
County of Orange, State of California, and is more particularly des-
cribed as follows, to wit:
Those portions of the South Half of fractional Section 22, the
Northeast Quarter of Section 28, and the Northwest Quarter of
Section 27, all in Township 4 South, Range 11 West, in the
Rancho Los Alamitos in the City of Cypress, County of Orange,
State of California, as said Sections are shown on Map No. 2
attached to the final decree of partition entered in the
Superior Court of Los Angeles County, Case No. 13527, a certi-
fied copy of said final decree having been recorded February 2,
1891, in Book 14, Page 31, of Deeds of said Orange County,
described as follows:
PARCEL NO. 1 (East side of Valley View Street, Cerritos to
Southern Pacific Railroad)
Beginning at the intersection of the Northerly line of that
certain strip of land 60.00 feet wide conveyed to the Southern
Pacific Railroad Company by deed recorded January 13, 1897, in
Book 29, Page 328 of Deeds, Records of said Orange County and
the West line of said Section 22, as said West line is shown on
a Record of Survey recorded in Book 44, Page 11, Records of said
Orange County; thence South 89° 46' 08" East along said Northerly
line 30.00 feet to a line parallel with and 30.00 feet Easterly,
measured at right angles, to the West line of said fractional
Section 22 and the true point of beginning; thence North 0° 13' 52"
East along said parallel line 446.21 feet to the beginning of a
tangent curve concave Easterly and having a radius of 1200.00
feet, said point of beginning being the Southerly point of cusp
of that certain parcel of land described in the deed recorded in
Book 6152, Page 145, Records of said Orange County; thence along
the Easterly line of said last mentioned parcel and Northerly
along said curve through a central angle of 7° 03' 29" an arc
length of 147.82 feet to a tangent line; thence North 7° 17' 21"
East along said tangent line 200.00 feet to the beginning of a
tangent curve concave Westerly and having a radius of 1200.00
feet; thence Northerly along said curve through a central angle
of 7° 12' 57" an arc length of 151.13 feet to a point on the
common boundary line between the Rancho Los Alamitos and the
Rancho Los Coyotes; thence leaving the Easterly line of said above
mentioned parcel South 70° 31' 22" East along said common Rancho
boundary line 32.10 feet; thence South 12° 00' 15" West 144.44
feet; thence South 7° 17' 21" West 200.00 feet to the beginning
of a tangent curve concave Easterly and having a radius of 1190.00
feet; thence Southerly along said curve through a central angle of
7° 03' 29", an arc distance of 146.59 feet to a tangent line that
is distant 40.00 feet Easterly measured at right angles to the

said parallel line 411.21 feet; thence South 54° 46' 37" East
61.03 feet to the Northerly line of said Southern Pacific Railroad

PARCEL NO. 2 (East side of Valley View Street from Southern Pacific
Railroad to Katella Avenue)
Beginning at the Southwest corner of the Southwest Quarter of
said fractional Sectional 22, as said corner is shown on a Record
of Survey recorded in Book 44, Page 11, of Records of said Orange
County, said corner being a point on the centerline of Katella
Avenue, 80.00 feet in width; thence along the West line of said
Section 22 North 0° 13' 52" East 40.00 feet to the Westerly pro-
longation of the Northerly line of Katella Avenue; thence South
89° 46' 23" East parallel to the South line of said fractional
Section 22 along said Westerly prolongation 30.00 feet to the
intersection of the Northerly right of way line of Katella Avenue
and the Easterly right of way line of Valley View Street and the
true point of beginning; thence North 0 13' 52" East parallel to
the West line of said fractional Section 22 along the Easterly
right of way line of Valley View Street, 1249.69 feet to the
Southerly line of that certain strip of land 60.00 feet wide
conveyed to the Southern Pacific Railroad Company by deed recorded
January 13, 1897 in Book 29, Page 328, of Deeds, Records of said
Orange County; thence South 89° 46' 08" East along said last
mentioned Southerly line 10.00 feet to a line parallel with and
40.00 feet Easterly measured at right angles to the West line of

10.57 feet to the beginning of a non tangent curve concave
Northeasterly and having a radius of 27.00 feet, a radial line
through said point bears North 89° 46' 08" West; thence Southeasterly
along said curve through a central angle of 90° 00' 15", an arc
distance of 42.41 feet; thence South 0° 13' 37" West 20.00 feet
to the Northerly right of way line of Katella Avenue; thence
North 89° 46' 23" West along said Northerly right of way line of
Katella Avenue 56.99 feet to the true point of beginning.
PARCEL NO. 3 (Valley View Street from Katella Avenue to Stanton
Storm Channel)
Beginning at the Northwest corner of said Section 27, as said corner
is shown on a Record of Survey recorded in Book 44, Page 11, of
Records of said Orange County, said corner being a point on the
centerline of Katella Avenue, 80.00 feetoin width; thence along
the West line of said Section 27 South 0 13' 52" West 40.00 feet
to the westerly prolongation of the Southerly line of Katella
Avenue; thence South 89° 46' 23" East parallel to the North line
of said Section 27 along said Westerly prolongation, 30.00 feet

intersection of Orangewood Avenue, 40.00 feet in width and Valley
View Street, 60.00 feet in width; thence along the West line of
said Section 27 and said centerline of Valley View Street North
0° 13' 52" East 20.00 feet to the Westerly prolongation of the
Northerly line of Orangewood Avenue; thence South 89° 46' 29"
East parallel to the South line of said Section 27 along said

Beginning at the Southeast corner of said Section 28, as said
corner is shown on a Record of Survey in Book 44, Page 11 of
Records of said Orange County, said corner being the centerline
intersection of Orangewood Avenue, 40.00 feet in width and
Valley View Street, 60.00 feet in width; thence along the East
line of said Section 28 and said centerline of Valley View
Street North 0° 13' 52" East 20.00 feet to the Easterly prolonga-
tion of the Northerly line of Orangewood Avenue; thence North
89° 46' 29" West parallel to the South line of said Section 28
along said Easterly prolongation, 30.00 feet to the intersection
of the Northerly right of way line of Orangewood Avenue and the
Westerly right of way line of Valley View Street and the true

27.00 feet; thence Southwesterly along said curve through a central
angle of 89° 59' 39", an arc distance of 42.41 feet to a point;
thence South 0° 13' 31" West 22.00 feet to the Northerly right of
way line of Orangewood Avenue; thence along said Northerly right of
way line of Orangewood Avenue South 89° 46' 29" East 57.00 feet to
the true point of beginning.
Section 3. Said public improvement is planned and located in a
manner which will be most compatible with the greatest public good and
the least private injury.
RESOLUTION NO. 766
Section 4. The firm of Rutan & Tucker, attorneys for the City
of Cypress, is hereby directed to bring an action in the Superior Court
of the State of California, in and for the County of Orange, in the
name of the City of Cypress, to condemn by eminent domain proceedings
the property described in Section 2 hereof.
Section 5. For the purposes of bringing such an action, the firm
of Rutan & Tucker is hereby empowered to incur, in the name of the City
of Cypress, all obligations and expenses incidental thereto.
The foregoing resolution is hereby approved and signed by me this
10th day of April, 1967.
