RESOLUTION NO. 801
A RESOLUTION OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, DETERMINING THAT THERE IS ONLY ONE
CONTRACTOR PRACTICALLY CAPABLE OF MAKING THE INSTALLATION
OF, SUPPLYING MAINTENANCE FOR, AND FURNISHING ELECTRIC
CURRENT FOR THE LIGHTING OF THE STREET LIGHTING SYSTEM
TO BE ANNEXED TO CYPRESS NO. 2 LIGHTING DISTRICT AND
ORDERED TO BE INSTALLED BY RESOLUTION NO. 779 OF SAID
COUNCIL, ALL IN ACCORD WITH AND PURSUANT TO THE PRO-
VISIONS OF DIVISION 14, PART 1, STREETS AND HIGHWAYS CODE,
STATE OF CALIFORNIA, AS AMENDED, REFERRED TO AS THE
"STREET LIGHTING ACT OF 1919".
WHEREAS, the City of Cypress, California, did in Resolution No. 779,
of said Council, order the installation of, maintenance of, and furnish-
ing of electric current for the lighting of a street lighting system on
certain public streets within said City, and the levy of assessments on
lands within the district thereby benefited, said district being that
area defined and described in the written report of the City Engineer
dated May 22nd, 1967, said report referred to and thereby made a part of
said Resolution No. 779; and,
WHEREAS, Division 14, Part 1, Streets and Highways Code, State of
California, as amended, hereinafter referred to as the "Street Lighting
Act of 1919", provides that the City Council may order the afore-
mentioned improvements to be carried out by a designated contractor, with-
out competitive bidding, if and when it is determined there exists only
one contractor practically capable of carrying out said improvement, and
said contractor is subject to the jurisdiction of the Public Utilities
Commission of the State of California; and,
WHEREAS, the Southern California Edison Company, a private utility,
does and is, the only supplier of electric current in the aforementioned
area to be benefited, and said Southern California Edison Company, is
subject to the jurisdiction of the Public Utilities Commission of the
State of California;
NOW, THEREFORE, IT IS HEREBY RESOLVED, ORDERED, AND DETERMINED BY
THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE, STATE OF
CALIFORNIA, as follows:
Section 1. That the Southern California Edison Company, a utility
subject to the jurisdiction of the Public Utilities Commission of the
State of California, is hereby declared, in accordance with the pro-
visions of the Street Lighting Act of 1919 and more particularly Section
18171 thereof, as amended, to be the only contractor practically capable
of carrying out the improvements ordered in Resolution No. 779 of said
Council.
Section 2. That the City Clerk of the City of Cypress is hereby
authorized and ordered to instruct the aforementioned contractor to carry
out said improvements in accord with specifications and plans as
designated in the City Engineer's report dated May 22, 1967, and by
reference made a part of Resolution No. 779 of said Council.
Section 3. The City Clerk shall certify to the adoption of this
Resolution, and the same shall thereupon take effect and be in force.
PASSED AND ADOPTED by the City Council of the City of Cypress, at
a regular meeting held on the 24th day of July, 1967.
