A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ENDORSING THE CALIFORNIA JUDICIAL MERIT PLAN.
WHEREAS, the Merit Plan for California court appointments has quickly
enlisted the support of many legislators, many judges and attorneys, many
civic, business, agricultural and labor leaders and many of the state's
publishers; and
WHEREAS, nominations to judicial office will be made by nominating
commissions; and
WHEREAS, in nominations to the Supreme Court or to courts of appeal,
there will be one state-wide Commission consisting of the Chief Justice as
Chairman, two lawyers appointed by the State Bar, and one judge and two
other citizens, neither lawyers nor judges, appointed by the Governor; and
WHEREAS, the state will be divided into five areas at the trial court
level: one for each appellate district, each District having its own
nominating commission, with each commission consisting of a court of appeal
judge selected by his colleagues as chairman, two lawyers appointed by the
State Bar, and one judge, and two other citizens, neither lawyers nor judges,
appointed by the Governor; and
WHEREAS, in addition, advisers will be appointed to insure that each
nominating commission has strong local contacts, and
WHEREAS, members of each commission will serve four-year staggered terms,
thus preventing the possibility of a "new broom sweeping clean" concept so
far as any appointing authority is concerned; and
WHEREAS, the nominating commissions will select and screen candidates
for the bench from names coming to them from any source, with these names to
be submitted to the Governor when a judicial vacancy occurs; and
WHEREAS, Plans to improve judicial sd.ection are widespread nationally,
with the American Judicature having endorsed a model state judicial article
which applies the principles of the California Merit Plan to theselection of
judges; and eleven states having passed laws embodying a merit plan for some
or allof their courts; and
WHEREAS, the California Judicial Merit Plan will give proper recognition
to the time-consuming physical task of searching out and selecting men and
women for judicial appointment in our ever growing state.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of
Cypress endorses the California Judicial Merit Plan as proposed in Senate
Constitutional Amendment 2, which is proposed to be on the November, 1968,
Election Ballot.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 10th day of June, 1968.
