A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
DENYING GENERAL PLAN AMENDMENT NO. 85-1.

WHEREAS, the City Council of the City of Cypress held a public hearing
at their meeting on the filth day of March 1985, to consider a proposed
Amendment to the Land Use Element of the General Plan, which Amendment would
change the designation of a certain parcel of land generally located on the
south side of Ball Road approximately 550 feet west of Valley View Street
behind 5900 Ball Road; and
WHEREAS, the City Council considered evidence presented at the public
hearing including a report prepared by the Planning staff; and
WHEREAS, the proposed Amendment would change the classification of the
subject property from retail and general commercial to high density resi-
dential; and
WHEREAS, after extensive discussion by the City Council, a motion was
made to deny the proposed General Plan Amendment.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cypress does deny General Plan Amendment No. 85-1, based on the following
findings:
A. The development of high density residential in such close proximity
to a commercial area,which has already resulted in noise problems for the
single-family residences located farther away from the subject site, would
result in additional noise problems at the proposed location. This finding
is based upon testimony at the public hearing by residents adjacent to or
near the property.
B. The access easement that has been granted to the adjacent savings
and loan is the only ingress and egress for the proposed high density resi-
dential property, resulting in poor circulation for the existing site.
C. A high density residential use on the subject site would result in
traffic congestion at peak hours on Ball Road. This finding is based upon
testimony at the public hearing by residents adjacent to or near the property.
D. The property owner created the existing situation by constructing
a savings and loan at the front of an existing rectangular parcel and then
splitting off a flag lot to the rear of the building with the sole access to
the site being provided by a 37.5 -foot driveway which is shared with the
savings and loan. At that time the applicant indicated proposed uses for
the flag lot to be "low traffic volume uses."
E. Impact on peak traffic, limited access and noise problems raise con-
cerns regarding the safety of the public.
PASSED AND ADOPTED by the City Council of the City of Cypress at an
adjourned regular meeting held on the 11th day of March 1985.
