Resolution No. 2891RESOLUTION NO. 2891 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SETTING FORTH THE LOCAL CONDITIONS AND THE PUBLIC SAFETY FACTORS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT CERTAIN MODLFICATTONS TO THE FOLLOWING CODES ARE REASONABLY REQUIRED BY LOCAL COND L'TTONS AND PUBLIC SAFETY FACTORS WTTHIN THE CITY OF CYPRESS: THE 1982 EDLTTON OF THE UNIFORM BUILDING CODE, THE 1982 EDITION OF THE (UNIFORM MECHAN[LA.T. CODE, TIT. 1982 EDITION OF THE UNIFORM HOUSING CODE, 'THP. 1982 EDITION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDLNCS, THE 1.982 EDITION OF THE UNIFORM ETRE CODE, AND f]U• 1982 EDITION OF THE UNIFORM BUILDING CODE STANDARDS. 24o THE CITY COUNCIL OF THE CLT(' 0"r CYPRESS DOES HEREBY R:SOT.VE AS FOLLOWS: WHEREAS, health and Safety Code Seoli„n 17922 requires the City of Cypress to adopt the most current editions of Inv ButL,ling Codes; and WHEREAS, Health ane Safely Code Sect inn L7958.5 provides for the City Council to make charges or modilicat luny in Llcc r:osL current editions of the Building Codes as may be reasonably nr essary hecaus, gatTn local conditions; and WHEREAS, the Building Otiicia1 recommended chat, based upon certa1 modifications to the 1.982 editions , are reasonably required to be f the City o1 Cypress has determined and Local conditions within the City of Cypress, the the Building Codes contained in Ordinance No. dopted by the City of Cypress; and WHEREAS, Health and Safety Code Section 17938.7 requires the City Council to make express findings of the necessity Jor modifications in the most current editions of the Building Codes. Section 510 - Sanitation added as a requirement for Clarification is added to the i to preclude moisture damage. work items requiring a 11ation requirements for shower stalls Section 1.210 - Fire -Warning and Sprinkler Systems A requirement is added to provide tor smoke detectors as a condition of escrow upon change of ownership of hotels, apartments, dwellings, and lodging houses. 246 Section 1715 - Atriums A requirement for a second exit is added when more than two tenants take access off an atrium. Section 2504 - Stresses Plywood used in exterior applications is required to be only of the exterior type. Section 3202 - Roof Construction and Materials Fire retardant roofs are required for all types of construction. Section 3203 - Rool Coverings Untreated wood shingles and shakes are prohibited as ordinary roof coverings. Appendix Section 5301 - Energy Conservation Energy conservation regulations shall comply with the California Administrative Code. Other Modifications Fees cited in Chapters 3 and 70 are specifically deleted from the ordinance adopting the Uniform Building Code. Fees will be established by separate action. Appendix Chapters 11, 32, 49, 53, and 70 are adopted as additional regulations of the Uniform Building Code. II. UNIFORM MECHANICAL CODE, 1982 EDITION Section 508 - Location Mechanical equipment is prohibited from being installed in front or side yard set -hack areas. Other Modifications Fees cited in Chapter 3 are specifically deleted from the ordinance adopting the Uniform Mechanical Code. Fees will be established by separate action. Appendices A, B and C, only, are adopted as additional regulations of the Uniform Mechanical Code. III. UNIFORM HOUSING CODE, 1982 EDITION Section 201 - Enforcement - General The County of Orange, Health Care Agency, is added as an enforcing agency for housing code violations. IV. UNIFORM FIRE CODE, 1982 EDITION Section 10.206 - Obstruction of Fire Protection Equipment Criminal penalties are established for violation of provisions of the Code. Section 10.207 - Access Roadways for Fire Apparatus Clarification of restricted parking areas for fire apparatus access and enforcement responsibil. ity is added to this Section. Section 10.301 - Installation Fire hydrants are added to the list of devices applicable to especially hazardous occupancies. All. fire hydrants are not required to be accessi- ble by roadways meeting the standards of Section 10.207. Section 10.307 - Fire Alarm System Detailed requirements are added to control the installation, maintenance, and inspection of smoke detectors in existing and new apartments, hotels, lodging houses, and residences. Section 10,316 - Special Provisions for High -Rise Buildings Enforcement of the Code is provided for in occupied buildings over 55 feet above the lowest floor level. Sections.78.102, 78.103, and 78.104 - Fireworks - Permits for Manufacturing, Sale and Discharge Detailed requirements are added to control the permitted sale of fireworks. Section 81.106 - Smoke Removal Additional requirements are added to the provisions for installation of smoke -removal control switches. Section 81.107 - Roof Vents, Venting Ratios and Draft Curtains Powered smoke removal systems are required if exemption is desired from restrictions of this Section regarding high -piled, combustible stock. BE IT FURTHER RESOLVED that a copy of this Resolution, together with a copy of Ordinance No. adopting the 1982 editions of the Building Codes, as amended, be filed with the State Department of Housing and Community Development.
