Resolution No. 2892RESOLUTION NO. 2892 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SETTING FORTH THE LOCAL CONDITIONS AND THE PUBLIC SAFETY FACTORS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT CERTAIN MODIFICATIONS TO THE FOLLOWING CODES ARE REASONABLY REQUIRED BY LOCAL CONDITIONS AND PUBLIC SAFETY FACTORS WITHIN THE CITY OF CYPRESS: THE 1982 EDITION OF THE UNIFORM PLUMBING CODE, the 1982 EDITION OF THE UNIFORM SWIMMING POOL CODE, THE 1982 EDITION OF THE UNIFORM SOLAR ENERGY CODE, AND THE UNIFORM PLUMBING CODE MATERIAL AND INSTALLATION STANDARDS. WHEREAS, Health and Safety Code Section 17922 requires the City of Cypress to adopt the most current editions of the Plumbing Codes; and WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council to make changes or modifications in the most current editions of the Plumbing Codes as may be reasonably necessary because of certain local conditions; and WHEREAS, the Building Official of the City of Cypress has determined and recommended that, based upon certain local conditions within the City of Cypress, the modifications to the 1982 editions of the Plumbing Codes contained in Ordinance No. are reasonably required to be adopted by the City of Cypress; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings or the necessity for modifications in the most current editions of the Plumbing Codes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that the following amendments and modifications to the 1982 editions of the Plumbing Codes contained in Ordinance No. are hereby found to be reasonably necessary due to considerations of certain local conditions: 1. UNIFORM PLUMBING CODE, 1982 EDITION Section 20.1 - Administrative Authority The Building Official is designated as the "Administrative Authority" as used in the Code. Section 20.3 - Violation and Penalties Criminal penalties are established for violation of provisions of the Code. Section 20.6 - Application for Permit Provisions are established for terminating permits for which work is not satisfactorily progressing. Section 20.7 - Cost of Permit Fees cited in this Section are specifically deleted from the Ordinance adopting the Uniform Plumbing Code. Fees will be established by separate action. A provision is established for partial refund of fees for which work is not commenced. Section 203 - Use of Copper Tubing Continuouslengths of copper tubing are required under slabs. Section 316 - Hangers and Supports Insulating material is required to allow for expansion and contraction. Section 903 - Overflows Rodent Proofing of slabs is required at plumbing openings. Section 1009 - Size of Potable Water Piping 249 Minimum numbers and sizes of outdoor plumbing connections are required in front and back yards. II. UNIFORM SWIMMING POOL CODE, 1982 EDITION Section 1.7 - Violation and Penalties Criminal penalties are established for violation of the provisions of the Code. Section 1.10 - Application for Permit Pre -site inspections and conformance to California energy regulations are required. Section 1..1.1 - Cost of Permit Fees cited in this Section are specifically deleted from the Ordinance adopting the Uniform Swimming Pool Code. Fees will be established by separate action. lli. ADDITIONAL SWIMMING POOL. PROVISIONS Sections 19-10, 19-11, 19-12, and 19-13 of the Cypress City Code regulate pool enclosures and gates and provide standards for clarity and cleanliness of pools. IV. UNIFORM SOLAR ENERGY CODE, 1982 EDITION Section 20.3 - Violation and Penalties Criminal penalties are established for violation of the provisions of the Code. Section 20.5 - Application for Permit Provisions are established for terminating permits for which work is not satisfactorily progressing. Section 20.6 - Cost of Permit Fees cited in this Section are specifically deleted from the Ordinance adopting the Uniform Solar Energy Code. Fees will be established by separate action. A provision is established for partial refund of fees for which work is not commenced. BE 1T FURTHER RESOLVED that a copy of this Resolution, together with a copy of Ordinance No. adopting the 1982 editions of the Plumbing Codes, as amended, be filed with the State Department of Housing and Community Development.
