RESOLUTION NO. 2902
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 85-6 - WITH CONDITIONS
WHEREAS, an application was filed for a Conditional Use Permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress to allow the construction of a gasoline island containing two
gasoline pump dispensers and expansion of the existing canopy at 4002 Ball
Road, Cypress.
WHEREAS, the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law.
NOW, THEREFORE, the City Councilhereby finds that:
1. The proposed location of the conditional use is in accord with the
objectives of the Zoning Ordinance and the criteria established for expanding
a non -conforming use in a zone within which it is not currently permitted.
2. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental to
the public health, safety or welfare or be materially injurious to properties
or improvements in the vicinity in that:
a. The proposed project will not adversely affect the traffic
flow along Ball Road or Bloomfield Street, nor should it
impact onsite circulation.
b. The proposed use is compatible with the surrounding
neighborhood.
c. Although the use is non -conforming, the proposal does not
expand beyond the ten percent (10%) permitted by the Code;
therefore, the proposed use is consistent with the goals and
objectives of the Cypress General Plan and Zoning Ordinance.
3. The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance except for approved variances or adjustments.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council DOES HEREBY
GRANT said conditional use permit, subject to the conditions attached hereto
as Exhibit "A."
PASSED AND ADOPTED BY fHE City Council of the City of Cypress at a
regular meeting held on the 8th day of April 1985.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 85-6
1. The developer shall conform to all applicable provisions of the City
Code'.
2. The developer shall comply with all requirements of the Orange County
Fire Marshal's office.
3. The corner cut-off easement shall be dedicated to the City for roadway
purposes.
4. No left -turn access shall be provided from Ball Road to this gas
station.
5. A five foot (5') landscaped planter shall be installed along the entire
length of the south property line and a three foot (3') landscaped
planter shall be installed along the east property line.
6. A detailed landscape and irrigation plan shall be submitted to the
Planning Department for review and approval at least 60 days prior to
issuance of a Certificate of Occupancy. In addition, a bond shall be
posted with the Public Works Department to guarantee against any
defects in plant materials and workmanship and an off-site landscape
and irrigation system shall be installed and maintained by the
developer.
