RESOLUTION NO. 2905
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
SUPERSEDING RESOLUTION NO. 2893 AND SETTING FORTH THE LOCAL
CONDITIONS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE
CITY COUNCIL THAT MODIFICATIONS TO THE 1984 EDITION OF THE
NATIONAL ELECTRICAL CODE ARE REASONABLY REQUIRED BY LOCAL
CONDITIONS WITHIN THE CITY OF CYPRESS.
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, Health and Safety Code Section 17922 requires the City of Cypress to
adopt the most current edition of the National Electrical Code; and
WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council
to make changes or modifications in the most current edition of the National Electrical
Code as may be reasonably necessary because of certain local conditions; and
WHEREAS, the Building Official of the City of Cypress has determined and
recommended that, based upon certain local conditions within the City of Cypress,
the modifications to the 1984 edition of the National Electrical Code contained in
Ordinance No. 742 are reasonably required to be adopted by the City of Cypress;
and
WHEREAS, Health and Safety code Section 17958.7 requires the City Council to
make express findings of the necessity for modifications in the most current edition
of the National Electrical Code; and
WHEREAS, it is appropriate to describe the specific local conditions upon which
each said modification is based.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that
the following amendments and modifications to the 1984 edition of the National Electrical
Code contained in Ordinance No. 742 are hereby found to be reasonably necessary due
to consideration of specific local climatic, geological, or topographical conditions as
follows:
1. Local climatic conditions necessitate that residential dwelling units be
protected from fire -related construction or electricity usage practices.
(Affects Sections 110-5, 210-1, 210-52(f), 210-70(a), 215-10, 220-3, 230-43,
300-13(b), 336-3, 350-2, and 422-5)
2. Local climatic conditions require that grounding electrodes be manufactured
of corrosion -resistant materials. (Affects Section 250-81(c))
3. Modifications to Section 90-4 are administrative amendments of local
discretion.
BE IT FURTHER RESOLVED that a copy of this Resolution, together with a copy of
Ordinance No. 742 adopting the 1984 edition of National Electrical Code, as amended,
be filed with the State Department of Housing and Community Development.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting
held on the 8th day of April , 1985.
