RESOLUTION NO. 2981
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 85-15 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of
the City of Cypress to operate a juice and beverage processing plant as
an accessory use to the existing drive-thru dairy located at 6297 Ball Road.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is:
Intended as an area for the location of retail and
wholesale commercial activities.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) This project should not create a substantially
adverse physical change within the affected
area, including land, air, water, minerals,
flora, fauna, ambient noise, and objects of
historical or aesthetic significance.
(2) Ball Road, a secondary highway, is adequate in
size and improvements to accommodate any
additional traffic generated by this project.
(3)
The proposed project is consistent with the
goals and objectives of the Cypress General
Plan and Zoning Ordinance.
(4) All product and material storage will occur
within the building.
(5) The applicant will comply with Article VII,
Noise Control of the Cypress City Code and
will keep the north access doors closed during
all hours of business operation.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 10th day of September 1985.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 85-15
1. The developer shall conform to allapplicable provisions of the City
Code.
2. Drainage shall be solved to the satisfaction of the City Engineer. A
grading and striping plan, signed by a registered California civil
engineer and using actual grades from an Orange County surveyor's
Benchmark shall be submitted for approval.
3. Reconstruct asphalt parking and drive areas with concrete gutters and
pavement repair to the satisfaction of the City Engineer. Concrete
gutters shall have a minimum flowline grade of two-tenths (.27) percent.
4. On Ball Road, 30 feet of lifted curb and gutter shall be removed and
replaced; a 15 gallon street tree with root barrier shall be replaced
in the empty treewell, and a 17 foot by 8 foot area of lifted sidewalk
shall be removed and replaced per city standards.
5. A1l existing public improvements at the development site which are da-
maged due to construction, cracked, or otherwise below standard, shall
be removed and replaced to the satisfaction of the City Engineer.
6. All product and material storage shall occur within the building.
Exterior storage is specifically prohibited, including the storage
of trucks and processing equipment.
7. A comprehensive sign program for both building and freestanding monu-
ment signs shall be submitted for Planning Department approval prior
to any signing installation. The developer shall not erect or display
on the subject property any signs which have not been approved in
writing by the Planning Department.
8. A detailed Landscape and automatic irrigation plan shall be submitted
to the Planning Department Cor review and approval at least sixty (60)
days prior to issuance of a Certificate of Occupancy. In addition, a
bond shall be posted with the Public Works Department to guarantee
against any defects in plant materials and workmanship.
9. The developer shall provide an adequate number of trash enclosures on-
site and at a location acceptable to City staff.
10. The north access doors to the business premises facing the adjoining
single family residences shalt remain closed during all hours of busi-
ness operation.
11. All requirements of the Orange County Fire Marshall's Office, Orange
County Health Department and Cypress Building and Safety Department
shall be satisfied prior to commencement of the business operation.

12. The applicant shall comply with the Article VII,
of the Cypress City Code.
Noise Control,
13. A six foul (6') high concrete block wall shall be constructed as
shown on the site plan submitted.
14. All unauthorized signs shall be removed from the block wall along
the east property line.
15. The applicant shall obtain a City of Cypress business license for the
operation of the beverage processing operation.
16. Pees required for improvements arc as follows:
a. Engineering plan checking and inspection fee. (per Resolution 1713)
b. Drainage fee for Master Drainage Plan (Per Resolution 2287)
