RESOLUTION NO. 2998
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 85-24 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of
the City of Cypress to permit the placement of fifteen (15) storage con-
tainers in the rear parking lot of Cypress East Shopping Center (behind
Mervyn's Department Store) located at 10201 Valley View Street, from
October 29, 1985 until January 1, 1986.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is:
Intended as an area for the location of retail and
wholesale commercial activities.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained wi11 not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) The City Council has included a condition of
approval whereby if complaints of noise arc
made to the Planning Department, these will be
forwarded to the City Council, which, at its
discretion, may modify or terminate the permit.
(2) Permission for the storage containers has been
granted from October 29, 1985 until January 1,
1986 only. Therefore, this will have no
long-term impacts on the surrounding properties.
(3)
Potential noise problems arc being mitigated by
restricting access to the containers between the
hours of 8:30 a.m. to 5 p.m. Monday through
Friday, 9:30 a.m. to 5 p.m. on Saturday, and
10 a.m. to 5 p.m. on Sunday.
(4) The containers will be brought on the site as
they are needed. This will result in fewer
containers on the site initially with the
maximum placement occurring later in the pro-
posed time period.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 28th day of October 1985.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 85-24
1. The City Council shall maintain the right to review and modify
Conditional Use Permit No. 85-24, subject to a public hearing
should substantiated complaints be received that the storage
containers are creating an adverse impact upon neighboring
properties.
2. If complaints of noise are made to the Planning Department, these
will be forwarded to the City Council, which, at its discretion,
may modify or terminate the permit.
3. Access to the storage containers shall be limited to between the
hours of 8:30 a.m. to 5 p.m. Monday through Friday, 9:30 a.m. to
5 p.m. on Saturday, and 10 a.m. to 5 p.m. on Sunday.
4. The applicant/developer shall comply with all provisions of the
Cypress City Code and all requirements of the Orange County Fire
Marshall's Office.
5. The storage containers shall be removed from the site on or before
January 1, 1986. A cash bond shall be posted for $750.00 with the
Public Works Department prior to the placement of the containers on
the site to guarantee the removal of the containers.
