RESOLUTION NO. 2514
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING PARCEL MAP NO. 82-1116 - WITH CONDITIONS.
WHEREAS, an application was made by Dr. Andrew N. Burpee to consolidate
two existing parcels into one parcel of land generally located at 6269 Ball
Road, Cypress.
WHEREAS, the City Council considered evidence presented by the Applicant,
City staff and other interested parties at a public meeting held with respect
thereto.
NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY
RESOLVE as follows:
1. The proposed map is compatible with the objectives, policies, general
land uses and programs specified in the General Plan of the City of Cypress
in that:
a. The proposed subdivision conforms with the Land Use Element
of the City's General Plan and the present regulations
according to the CG -10,000 Commercial General Zone for which
this property is presently zoned.
b. Full public street improvements will be made adjacent to this
property, thereby accommodating any anticipated Increase in
traffic generated by the future land use.
2. The design and improvement of the proposed subdivision as designated
on the parcel map and supplemented by the condition, and incorporated herein
by reference, is compatible with the objectives, policies, general land uses
and programs specified in the General Plan of the City of Cypress in that:
a. The subject property shall be improved in conformance with
present zoning and all applicable ordinances in effect at
the time this map is recorded with the County of Orange.
All necessary utility services will be provided to the
property in conformance with the Cypress Municipal Code.
3. None of the findings set forth in Government Code Section 66474 can
be made.
4. The discharge of waste from the proposed subdivision into the exist-
ing community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control
Board having jurisdiction over the proposed subdivision pursuant to the
provisions of Division 7 of the California Water Code (Sections 13000 et seq.).
Denial of a subdivision for violation of the proposed waste discharge standards
or an addition to an existing violation thereof, is a ground for denial of the
tentative subdivision map, although such denial is not mandatory.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Parcel Map No. 82-1116, subject to the
conditions in Exhibit "A" attached.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 24th day of May 1982.

TENTATIVE PARCEL MAP NO. 82-1116
1. Developer shall conform to all applicable provisions of the City Code.
All requirements of the State Subdivision Map Act and City Subdivision
Ordinance shall be satisfied. The Parcel Map shall be to standard
engineering scale.
2. Juanita Street shall be dedicated and fully improved with curb, gutter,
sidewalk, drive approach, etc., in accordance with the master plan of
streets and highways. Street treewells shall be installed 40 feet on
center and 15 gallon Magnolia Trees planted. The south portion of the
drive approach on Juanita Street shall be completed per City Standard.
Settlement in the existing utility trench in Juanita Street shall be
repaired by removing and replacing asphalt concrete paving. Traffic
signs, if necessary, shall be installed per City Standards. The dirt
area in back of the sidewalk on Juanita Street shall be graded to a
slope no greater than 3:1.
3. In the existing empty treewell on Ball Road, the stump shall be removed
and a 15 gallon Carrotwood Tree planted.
4. The driveway located at the north property line of this parcel shall
be brought up to City Standards. The asphalt concrete shall be 3/8 inch
higher than lip of gutter, the asphalt concrete shall have a 2% minimum
cross fall, and all dirt, sand and weeds shall be cleaned out of gutter.
5. A roadway improvement construction plan shall be submitted for City
approval. This plan shall be drawn in ink on mylar, signed by a
registered engineer and shall use actual grades based on Orange County
Surveyor's benchmark. All work on Ball Road, Juanita Street, and on
driveway off of Juanita Street shall be shown on the construction plan.
All existing public improvements at the development site which are
damaged, cracked or otherwise below standard, shall be removed and
replaced to the satisfaction of the City Engineer.
6. The vacant parcel shall be cleared of all debris, litter and excessive
dirt dumped on the property and shall be fenced off with a chain link
fence to prevent future dumping.
7. Developer shall provide the City with a Certificate of Insurance
evidencing a comprehensive liability insurance policy(s) with a com-
bined single limit of not less than $500,000 each occurrence in con-
nection with the work performed. Certificate shall include the City
as additional insured. Policy shall include the City, its Council,
officers, members of boards or commissions and employees are hereby
declared to be additional Named Insureds with respect to all claims,
actions, damages, liabilities and expenses, including attorney's fees

arising out of or in connection with the work to be performed under
the development executed by the Named Insured and City, including
any act or omission of employees, agents, subcontractors, or their
employees. Such certificate shall have a thirty (30) day cancellation
notice to the City of Cypress.
FEES REQUIRED FOR IMPROVEMENTS ARE AS FOLLOWS:
. Final subdivision map filing fee.
. Engineering plan checking and inspection fee.
. Drainage fee for Master Drainage Plan.
