A RESOLUUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
REVOKING CONDITIONAL USE PERMIT NO. 81-19.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
SECTION 1. On July 27, 1981, the City Council of the City of
Cypress approved Conditional Use Permit No. 81-19, permitting the
establishment of a video amusement arcade at 4917 Lincoln Avenue,
Cypress, in the Cfi-10,000 Commercial Heavy Zone. Said conditional
use permit included the following conditions:

City Council on an annual basis from the date of City Council.
approval, with the City Council reserving the right to modify
or revoke said conditional use permit.
The City Council may modify or revoke Conditional. Use Permit
No. 81-19 should it determine that the business is being
operated or maintained in a manner detrimental to the public
health, safety, or welfare or materially injurious to pro-
perties or improvements in the vicinity.
SECTION 2. On September 27, 1982, the City Council conducted a public
hearing to review Conditional Use Permit No. 81-19 in accordance with Condi-
tion No. 6 to receive public testimony and evidence concerning the operation
of the business and its impact upon the surrounding community. Said public
hearing was continued from September 27, 1982 to November 8, 1982 to receive
input from the City's Chief of Police concerning the reported crime statistics
as they relate to the subject arcade, its surrounding shopping center and
other similar shopping centers in the City of Cypress. The City Council,
at its meeting on November 8, 1982, after receiving public testimony and
the requested report from the Chief of Police of the City of Cypress,
specifically determined that:
(a) The amusement arcade business is being operated and maintained
in a manner detrimental to the public safety and welfare of the
surrounding community and also materially injurious to properties
and improvements in the surrounding community.
(b) The reported statistics of criminal activity for the subject
shopping center as reported by the Chief of Police of the City
of Cypress clearly indicated to the City Council that a higher
level of criminal activity could be directly attributed to the
existence of Nikki's Amusement Arcade.
(c) For the reasons set forth hereinabove, the terms and conditions
applicable to Conditional Use Permit No. 81-19 have been violated.
SECTION 3. Conditional Use Permit No. 81-19 is hereby revoked effective
December 8, 1982, which is thirty (30) days from and after the date of this
Resolution.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 8th day of November 1982.
