RESOLUTION NO. 2580
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 82-7 -
WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an Application was filed for approval of a conditional use
permit in accordance with the provisions of Section 17.2 of the Zoning
Ordinance of the City of Cypress to allow Cypress Farms Produce to become a
convenience market allowing the offsale of alcoholic beverages (beer and
wine only) at 5491 Cerritos Avenue, in the CG -10,000 Commercial General
Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is:
Intended as an area for the location of retail and
wholesale commercial activities.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) The sale of alcoholic beverages is intended primarily
as a convenience to patrons of the produce market and
should not be detrimental to surrounding properties
or the community.
(2) The business owner must comply with all requirements
of the State of California Department of Alcoholic
Beverage Control, the regulatory agency over the
subject liquor license.
Approval to convert said produce market to a convenience
market will be subject to certain conditions which will
require removal of all illegal signing and re -landscaping
of existing weed infested planters.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.

4. The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting on the 8th day of November 1982.

RESUBMITTAL OF CONDITIONAL USE PERMIT NO. 82-7
1. The applicant shall submit a landscape plan for staff approval,
and re -landscape all planter areas according to the plan, prior
to issuance of the liquor license.
2. The applicant shall remove all illegal signing and obtain the
appropriate building permits for further signing in conformance
with the Zoning Ordinance prior to issuance of the liquor
license.
3. The applicant shall obtain design review approval and all
necessary building permits for the recently constructed building
addition.
4. The trash receptacle area on the north side of the building shall
be enclosed by a masonry wall to the specifications of City staff.
5. The applicant shall satisfy all necessary requirements of the
State Departnent of Alcoholic Beverage Control prior to
Conditional Use Permit No. 82-7 becoming effective.
6. The City Council shall maintain jurisdiction over the convenience
market's hours of operation and reserve the right to review or
limit the hours of operation should the offsite sale of alcoholic
beverages become detrimental to the surrounding community.
