Resolution No. 2584RESOLUTION NO. 2534 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 82-19 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESERVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to establish a church, Sunday school and related educational uses on the vacant Juliet Morris Elementary School site at 9952 Graham Street. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: To permit adequate identification of areas reserved and developed for public uses other than street rights-of-way, to provide for expansion of their operations or change in use and to identify and preserve areas of historic and community significance for the enjoyment of future generations. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The operation of a church with associated Sunday school should not be any more detrimental to the surrounding community than the former public elementary school in that adequate parking will be provided onsite and hours of church services are subject to regulation by the City Council. (2) Occupancy of the subject property will reduce the potential for vandalism since the Juliet Morris School has been vacated and closed by the Cypress School District. The Cypress Evangelical Free Church will provide security, security lighting and property maintenance of the school grounds. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." Any expansion of the proposed use beyond what is approved as part of Conditional Use Permit No. 82-19 will require an amendment to the conditional use permit. 2. The Juliet Morris Elementary School sports field shall be available for organized recreational usage as scheduled by the Cypress Recreation and Parks District. The subject church shall have first priority over sports field availability. 3. Onstrcet parking will not be permitted for church activities. All parking for church related uses shall be on the Juliet Morris Elementary School site. 4. Both parking lots A and B must be provided and maintained for their proposed usage. Initial preparation shall include slurry coating and restriping of "lot A." "Lot B" shall be slurry coated, restriped and a driveway constructed to "lot A" prior to September 1, 1983. 5. Plans for the proposed monument sign shall receive final approval from the City Design Review Committee. 6. This conditional use permit may be modified or revoked by the City Council should the Council determine that the proposed use, or con- ditions under which it is being operated or maintained, is detri- mental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. 7. Parking lot security lighting shall be provided subject to the approval of City staff. Said security lighting shall not directly shine or glare upon adjoining residential properties.
