Resolution No. 2637219 RESOLUTION NO. 2637 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT NO. 1 TO CONDITIONAL USE PERMIT NO. 82-13. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the terms of the Zoning Ordinance of the City of Cypress to amend the wording of condition of approval No. 2 of said use permit for Mitsubishi Motor Sales of America, Inc., at 6400 Katella Avenue, Cypress. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The amended conditional use permit will still comply with each of the applicable provisions of the City's Zoning Ordinance as origi- nally approved but simply permits a delay in construction of a portion of the project which should not produce significant adverse impacts upon surrounding properties during the time period as specified. 4. The City Council DOES HEREBY APPROVE said amendment to the con- ditional use permit where upon the new condition of approval No. 2 replacing the original condition of approval No. 2 shall read as follows: 2. Applicant shall be entitled to delay obtaining the building permits for Phase 1 of the office building up to April 1, 1985. Certificates of Occupancy for the depot warehouse, technical training center, emissions laboratory, and styling studio, shall be issued upon completion even though building permits for the office building have not yet been issued. In recognition of the loss of revenue to the City as a result of the delay in issuance of the building permits on the office building and the added cost to the City for rendering services such as fire, police, and other City services to that portion of the project which will have been completed prior to April 1, 1985, the applicant has agreed to pay the City $10,887.00 as partial compensation for these added costs. Additionally, the applicant shall enter into an agreement with the City which provides for liquidated damages in the amount of $1,210.00 per month for each month, or any portion thereof, delay, other than delay caused by the City's conduct, in obtaining the building permits for the office building after April 1, 1985, up to the date the permits are actually issued.
