RESOLUTION NO. 2650
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING PARCEL MAP NO. 83-1121 - WITH
CONDITIONS.
WHEREAS, an application was made by Mr. John E. Schwartz to divide
an L-shaped .85 acre parcel of land into two lots, designated as Parcels
1 and 2, generally located at 5022 Lincoln Avenue and 9042 Moody Street,
in the CH -10,000 Commercial heavy Zone.
WHEREAS, the City Council considered evidence presented by the
Applicant, City staff and other interested parties at a public meeting
held with respect thereto.
NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY
RESOLVE as follows:
1. The proposed map, in accordance with Section 66473.5 of the
State Subdivision Map Act, is compatible with the objectives and policies
of the General Plan of the City of Cypress.
2. The design and improvement of the proposed subdivision as desig-
nated on the tentative parcel map and incorporated herein by reference is
compatible with the requirements of the City's Zoning Ordinance since the
requested variance to allow less lot depth than that required by the
Zoning Ordinance was denied by the City Council of the City of Cypress.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the
City of Cypress DOES HEREBY APPROVE Parcel Map No. 83-1121.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 23rd day of May 1983.

PARCEL. MAP NO. 83-1121
1. Approval of this application is restricted to the division of one parcel
into two parcels of land. Any development would require plan approval
and permits by the City of Cypress.
2. The developer shall conform to all applicable provisions of the City Code.
All requirements of the State Subdivision Map Act, the City's Subdivision
Map Act and the City's Subdivision Ordinance shall be satisfied.
3. The southerly property line of Parcel 1 shall coincide with the back edge
of the existing plarter curb approximately 172 feet south of the north
property line.
4. Parcel 2 shall grant a private easement for ingress -egress and drainage
purposes in favor of Parcel 1. Said easement shall cover the entire
existing driveway adjacent to the north property line of Parcel 2.
5. At the time of development of Parcel 2, either that southwesterly portion
of Parcel 1 that is not improved shall be improved with paving and granted
as an casement for ingress -egress and drainage purposes in favor of
Parcel 2, or that same portion of Parcel 1 shall be improved as a planter
with curb, landscape and irrigation. The above improvements shall be per
City standards. A cash deposit of $600.00 shall be deposited with the
City to guarantee the installation of said planter or driveway paving.
6. A ten foot (10') wide sewer and public utility easement over the existing
sewer on Parcel 2 shall be granted in favor of Parcel 1. A sewer mainte-
nance agreement between said two parcels shall he approved by the City
Engineer and recorded prior to recordation of the Parcel Map.
7. An Ril - 18 inch by 18 inch, "DO NOT ENTER" sign shall be installed in the
eastern most portion of the existing planter adjacent to the northerly
property line of Parcels 1 and 2. Parcel 1 shall be allowed egress only
to Moody Street.
8. The final subdivision map filing fee shall be paid (per Resolution No.
1713).
