Resolution No. 2654247 RESOLUTION NO.2654 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 83-7 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESERVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct an office building and provide onsite improvements while varying from the six foot (6') fence height requirement, at Five City Automotive Repair Center, located at 4620 Lincoln Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: To provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. To promote a revitalization of the commercial areas on Lincoln Avenue and thereby enhance the economic base of the City. To improve the image of the City by providing an aesthetically pleasing environment along Lincoln Avenue. To expand opportunities for the develop- ment of identified deep lots by providing a means for the establishment of a variety of urban uses in con- junction with commercial projects. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The subject property has been occupied by the same use with an existing County conditional use permit since 1959. Therefore, approval of this conditional use permit should not be any more detrimental to the community than the existing business which occupies the site. (2) The property will be upgraded to provide parking, landscaping and screen walls around the outdoor storage area. c. The proposed conditional use will comply with each of the appli- cable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." The developer shall conform to all applicable provisions of the City Code. 2. Drainage shall be solved to the satisfaction of the City Engineer. A grading plan, in ink on mylar, signed by a registered Engineer and using actual grades from an Orange County Surveyor's benchmark, shall be sub- mitted for approval. All onsite drainage conveyed to the street shall be by means of an undersidewalk drain. In parking areas, A.C. shall have a minimum slope gradient of two percent (2%), and concrete shall have a minimum slope gradient of two-tenths percent (.2%). 3. Wheelchair and handicap access facilities shall be installed onsite and offsite in accordance with State of California and City of Cypress Building Department standards. 4. Onsite security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic. A11 roof mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view, subject to the approval of the City staff. 5. Recommendations for A.C. overlay or other treatment of all existing driveways and parking areas shall be by a soils report prepared by an engineering firm acceptable to the City Engineer. All existing public improvements at the development site which are damaged, cracked, or otherwise below standard, shall be removed and replaced to the satis- faction of the City Engineer. 6. The City requires that legal access, twenty-five feet (25') in width, be provided for the subject property. This can be accomplished either by (a) two (2) fifteen foot (15') wide reciprocal easements for ingress - egress, public utility and drainage purposes covering the northern most two hundred ten feet (210') of the existing driveway centered on the east property line of this development, executed by the owner of this proposed development and the property owner to the east; or (b) the property owner providing a twenty-five foot (25') wide driveway approach per City standards on the easterly side of this property. This would require the proposed office building to be located thirty-two feet (32') from the east property line. 7. If legal access is provided by a reciprocal easement, then the existing twenty foot (20') wide A.C. drive approach on Lincoln Avenue shall be removed and replaced with a P.C.C. approach per City standards. Said new approach shall have a width equal to twenty-five feet (25'), being widened five feet (5') in the easterly direction. 8. A left turn pocket on Lincoln Avenue for left -turn access to the drive approach to this development can be installed by the developer. The pocket shall be designed on a City street improvement plan by a regis- tered Civil Engineer, per City standards and approved by the City Engineer. A cash bond shall be deposited with the City for the cost of future Bomanite paving in the five foot (5') wide left -turn pocket nose and for one-half the cost of future landscaping of the median island in front of this development. 250 9. All secondary and primary utility services shall be underground. The street in front of this development shall be resurfaced with one inch (1") minimum thickness asphalt concrete cap from curb to curb if it is necessary to open cut the street in more than one place. Any open cut shall be backfilled per City of Cypress Standard No. 110. 10. One (1) street light shall be installed per City standards. 11. All public improvements shall be installed by means of a Public Works excavation permit. 12. Fees required for improvements are as follows: a. Drainage fee for Master Drainage Plan. b. Sanitary sewer connection fee. c. Advanced street light energy charges shall be paid (for a one-year period). d. All applicable Building Department fees.
