Resolution No. 2685302 RESOLUTION NO. 2685 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 83-17 WITH CONDITIONS. THE CITY COUNCIL. OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to establish a church, and school facility on the vacant MacKay Elementary School site at 8721 Cypress Street. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The Proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: To permit adequate indentification of areas reserved and developed for public uses other than street rights-of-way, to provide for expansion of their operations or change in use and to identify and preserve areas of historic and community significance for the enjoyment of future generations. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will nor be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: 1. The operation of a church and school facility should not be anymore detremintal to the surrounding community than the former public elementary school in that adequate parking will he provided onsite and provisions have been made for an expansion in parking if the need is determined by the Planning Director and the City Engineer. 2. An additional driveway will be installed on Walker Street to alleviate potential traffic congestion at the Cypress Avenue entrance. 3. Occupancy of the subject property will reduce the potential for vandalism since the MacKay School has been vacated and closed by the Cypress School District. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A". Any expansion of the proposed use beyond what is approved as part of Conditional Use Permit No. 83-17 will require an amendment to the conditional use permit. 2. Onstreet parking will not be permitted for church activities. Also, parking for church related uses shall be on the MacKay Elementary School site. 3. Plans for any proposed signage shall receive final approval from the City Design Review Committee. 4. The developer shall conform to all applicable provisions of the City Code. 5. Within six (6) months from the date of approval of this application, the existing parking lot shall be slurry sealed and striped. Should the need for additional parking spaces arise in the future, the applicant shall provide additional paved parking to accommodate that need to the satisfaction of the City Engineer and Planning Director. 6. This conditional use permit may be modified or revoked by the City Council should the Council determine that the proposed use, or con- ditions under which it is being operated or maintained, is detrimental to the public health, safety or welfare; or materially injurious to properties or improvements in the vicinity. 7. A twenty-five foot (25') wide asphalt concrete driveway shall be installed from the existing drive approach on Walker Street to the parking lot at the rear of the school site. Location of the new driveway shall be subject to the approval of the City Engineer. The driveways shall be constructed with a minimum section of two inch (2") asphalt concrete over four inch (4") crushed aggregate base. The above improvements shall be shown on a grading plan using actual grades from an Orange County surveyor's benchmark, signed by a registered Civil Engineer and submitted for approval by the City Engineer. The grading permit fee shall be paid. The ongoing use of drive entrances at Walker Street and Cypress Avenue shall be subject to review and approval of the City staff. Use of said entrances shall be modified as necessary to alleviate any negative impacts to surrounding streets. 8. A11 existing public improvements at the development site which are damaged or cracked due to construction shall be removed and replaced to the satisfaction of the City Engineer. 305 2 9. Developer shall provide the City with a Certificate of Insurance evidencing a comprehensive liability insurance policy(s) with a com- bined single limit of not less than $500,000 each occurrence in con- nection with the work performed. Certificate shall include the City as additional insured. Policy shall include the City, its Council, officers, members of boards or commissions and employees are hereby declared to be additional Named Insureds with respect to all claims, actions, damages, liabilities and expenses, including attorney's fees, arising out of or in connection with the work to be performed under the development executed by the Named Insured and City, including any act or omission of employees, agents, subcontractors, or their employees. Such certificate shall have a thirty (30) day cancellation notice to the City of Cypress. 10. Proposed parking plan shall be approved by the Planning Department and shall conform to all Zoning Ordinance standards. 11. The developer shall conform to all Fire Department requirements and a Fire Department inspection is required before occupancy.
