Resolution No. 2720RESOLUTION NO. 2720 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 83-23 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 362 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to establish a gymnastics school at 4562 Lincoln Avenue, N301 and 302. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: (1) To promote a revitalization of the commercial areas on Lincoln Avenue and thereby enhance the economic base of the City. (2) To improve the image of the City by providing an aesthetically pleasing environment along Lincoln Avenue. (3) To expand opportunities for the development of identified deep lots by providing a means for the establishment of a variety of urban uses in conjunction with commercial projects. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The gymnastics school should not adversely impact the surrounding properties since all doors will be required to be closed during the hours of operation. (2) The use permit is granted solely for the operation of a gymnastics school and not for any organized competition or gymnastics meet. (3) Incidental uses, such as exercise classes, are subject to additional restrictions from time to time as determined by staff to mitigate any potential impacts. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions in Exhibit "A" attached. All doors shall be closed during hours of operation. 2. The applicant shall conform to all applicable requirements of the City Code, the Orange County Fire Marshal's Office and the Cypress Building Department. 3. Plans for any proposed signage shall be approved by the Planning Director and all necessary permits shall be obtained. 4. This conditional use permit may be modified or revoked by the City Council should the Council determine that the proposed use, or conditions under which it is being operated or main- tained, is detrimental to the public health, safety or welfare; or materially injurious to the properties or improvements in the vicinity. 5. This conditional use permit is granted solely for the operation of a gymnastics school. Any organized competition, gymnastics meet or other related use is deemed to be an expansion of the conditional use permit and would require further consideration by the City Council. 6. Women's exercise classes may be permitted as an occasional, incidental use of the property, subject to such additional restrictions as the staff may from time to time determine, and to the extent that the staff determines the parking provisions available to be adequate to accommodate this additional usage.
