Resolution No. 1727RESOLUTION NO. 1727 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF CYPRESS TO ANNEX TO SUCH CITY CERTAIN UNINHABITED TERRITORY DESCRIBED THEREIN AND DESIGNATED AS "ANNEXATION NO. 76-1" SETTING FORTH ITS REASONS FOR DESIRING ANNEXATION AND GIVING NOTICE OF THE TIME AND PLACE SUCH CITY COUNCIL WILL HEAR WRITTEN PROTESTS AGAINST SUCH ANNEXATION. BE IT RESOLVED by the City Council of the City of Cypress as follows: SECTION 1. That, pursuant to the provisions of the Annexation of Unin- habited Territory Act of 1939, proceedings have been initiated by the City Council of the City of Cypress, on its own motion, to annex to the City of Cypress all that uninhabited territory situated in the County of Orange, State of California, herein designated as "Annexation No. 76-1", and des- cribed as follows: A parcel of land situated in the County of Orange, State of California, and being a portion of Sections 9 and 16, Township 4 South, Range 11 West, S.B.M.: Beginning at the intersection of the west line of the east -half of the northeast quarter of said Section 16 and the north line of said Section 16, as said Section is shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, Records of said Orange County, said intersection being a point on the corporate boundary of the City of Cypress as defined by De Polter Annexation, Ordinance No. 66; thence north 89° 46' 30" east 201.55 feet along the north line of said Section 16 to a point on the west line of the east 125 feet of the west half of the northwest quarter of the northeast quarter of the northeast quarter of said Section 16, said point being the true point of beginning. THENCE (1) South 0° 22' 13" east 675.80 feet along said west line and along the corporate boundary as defined by Annexation No. 71-1, Ordinance No. 449, to the south line of the north -half of the northeast quarter of the northeast quarter of said Section 16 and to a point in the original incorporation boundary of the City of Cypress (Dairy City). THENCE (2) North 89° 41' 15" east along said original incorporation boundary and said south line 778.10 feet to the west line of the east -half of the northeast quarter of the said northeast quarter of the northeast quarter of Section 16; THENCE (3) North 0° 12' 51" west 70.00 feet along said west line and along the corporate boundary as defined by Annexation No. 68-4, Resolution No. 930 to intersect the north line of the south 70 feet of the said northeast quarter of the north- east quarter of the northeast quarter of Section 16; THENCE (4) North 89° 41' 15" east 295.72 feet, more or less, along said north line and along said Annexation No. 68-4 to a line parallel with and distant 30.00 feet westerly from the east line of said Section 16, said parallel line being the westerly right of way line of Valley View Street (formerly known as Miller Street); THENCE (5) North 0° 12' 51" west 537.67 feet along said west right of way line to the south line of the north 66 feet of said Section 16, said south line being a portion of the boundary line of the City of Buena Park as established by Miller Street Annexation No. 3, Ordinance No. 282; and also being the southerly right of way line of Lincoln Avenue; 281 THENCE (6) South 89° 46' 30" west, 216.37 feet along said south line to intersect the southerly prolongation of the west line of the east 246.37 feet of said Section 9; THENCE (7) North 0° 13' 30" west 106.00 feet along said southerly prolongation, the said west line and the boundary of the said Miller Street Annexation No. 3 to the north line of the south 40 feet of said Section 9, said north line being the northerly right of way line of Lincoln Avenue, and said point being an angle point in the boundary line of the City of Buena Park as established by Larwin Homes Annexation No. 1, Ordinance No. 159; THENCE (8) South 89° 46' 30" west along said northerly right of way line and the boundary line of said Larwin Homes Annexation No. 1, 858.21 feet to the said west line of the east 125 feet; THENCE (9) South 0° 22' 13" east 40.00 feet along said west line to the north line of said Section 16, being the true point of beginning. Containing 16.64 acres of land more or less. SECTION 2. That the City Council of the City of Cypress desires to annex said uninhabited territory to the City of Cypress for the following reasons: The territory is contiguous to the City of Cypress; its proposed annexation will contribute to and facilitate the orderly growth and develop- ment of both the City of Cypress and the territory proposed to be annexed; its proposed annexation will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and street sewers and drainage facilities, both within the City of Cypress and the territory proposed to be annexed; and its proposed annexation will provide and facilitate a proper overall planning and zoning of lands and subdivisions of lands in the City of Cypress and in said uninhabited territory in a manner most conducive to the welfare of said City of Cypress and said uninhabited territory. SECTION 3. That the Local Agency Formation Commission of Orange County, California, on May 26, 1976, approved "Annexation No. 76-1". SECTION 4. That July 12, 1976, at the hour of 8:00 p.m., in the City Council Chambers of the City Hall of the City of Cypress, County of Orange, State of California, located at 5275 Orange Avenue, Cypress, California, is hereby fixed as the time and place when and where any owners of real property within such territory proposed to be annexed, having any objections to such proposed annexation, may appear before the City Council of the City of Cypress and show cause why such uninhabited territory should not be so annexed to the City of Cypress. Such protest must be in writing and may be filed at any time prior to final adjournment of such hearing on protests. The protest shall state the name of the owner of the property affected and the street address or other description of property sufficient to identify it on the last equalized assessment roll. SECTION 5. That since there is no newspaper of general circulation pub- lished within the City of Cypress, the City Clerk of the City of Cypress hereby is authorized and directed to post a copy of this Resolution not less than twenty (20) days before the hearing in at least three conspicuous places within such territory proposed to be annexed. The City Clerk of the City of Cypress further is authorized and directed to cause said notice to be published in a newspaper of general circulation published outside the City of Cypress, but within the County of Orange in accordance with Section 35311 of the Government Code of the State of California. The City Clerk of the City of Cypress further is authorized and directed to cause written notice of such proposed annexation to be mailed at least twenty (20) days prior to the date set for such hearing, to each person to whom land within such territory pro- posed to be annexed is assessed on the last equalized assessment roll available 282 on the date the proceedings were initiated, at the address shown on said assessment roll, or as known to the said City Clerk, and to any person who has filed his name and address and the designation of such lands in which he has any interest, either legal or equitable, with said City Clerk. The City Clerk of the City of Cypress further is authorized and directed to cause written notice to be given to such other persons as legally may be entitled thereto in the manner provided by law.
