A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CYPRESS APPROVING TENTATIVE PARCEL MAP
NO. 76-5, WITH CONDITIONS
WHEREAS, an application was made by Eastern Pacific Development Company
to divide 3.4 acres of land into two lots yeilding a density of zero units
per acre located on the southerly side of Orange Avenue, easterly of Grindlay
Street; and
WHEREAS, the City Council considered evidence presented by the Applicant,
the Planning Commission, City staff and other interested parties at a public
meeting held with respect thereto.
NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY
RESOLVE as follows:
1. The proposed map is compatible with the objectives, policies,
general land uses and programs specified in the General Plan of the City
of Cypress in that:
a. The map will facilitate the development of the subject property
in conformance with the development standards as contained in the
City's Zoning Ordinance and in accordance with the long-range
objectives as outlined in the City's General Plan.
b. The lots created by this map will result in the establishment
of uses which will not be detrimental to or incompatible with the
Noise Element of the General Plan and will not facilitate the
establishment of uses that will produce traffic volumes in excess
of the capacity planned for the adjacent arterial street as outlined
on the Circulation Element of the General Plan.
2. The design and improvement of the proposed subdivision as designated
on the Tentative Parcel Map and supplemented by the conditions attached
hereto as Exhibit "A," and incorporated herein by reference, are compatible
with the objectives, policies, general land uses and programs specified in
the General Plan of the City of Cypress in that:
a. The conditions applied to the approval of this Map will insure the
installation of required off-site improvements in accordance with the
general policies and specifications of the City as outlined in the
various elements of the City's General Plan.
b. The "design" of the lots produced by this map will not, per se,
result in any detrimental effects to adjacent properties.
3. None of the findings set forth in Government Code Section 66474 can be
made.
4. The discharge of waste from the proposed subdivision into the existing
community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control
Board having jurisdiction over the proposed subdivision pursuant to the
provisions of Division 7 of the California Water Code (Sections 13000 et sect.).
Denial of a subdivision for violation of the proposed waste discharge
standards or an addition to an existing violation thereof, is a ground for
denial of the Tentative Parcel Map, although such denial is not mandatory.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Parcel Map No. 76-5, subject to
the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cypress on the 14th day of June, 1976.

EXHIBIT "A"
Tentative Parcel Map No. 76-5
1. All conditions of approval of Conditional Use Permit No. 76-2, as required
by the Planning Commission, shall be applicable to this Parcel Map as
they relate to Parcel #1.
2. The applicant shall submit a soils report in accordance with City
standards for review by the Building Superintendent.
3. A grading plan shall be submitted for review and approval by the
Building Superintendent prior to the start of any grading or construction
on the subject property.
4. The applicant shall comply with all conditions of the State Subdivision
Map Act and the City's Subdivision Ordinance relative to the approval and
recordation of the subject Parcel Map.
5. No ingress or egress to Parcel 42 will be permitted within 250 lineal
feet of the property line separating Parcels #1 and #2 unless the driveway
on Parcel #1, located 607 lineal feet east of Grindley, is closed.
