Resolution No. 1733290 RESOLUTION NO. 1733 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE PARCEL MAP NO. 76-6, WITH CONDITIONS WHEREAS, an application was made by William and Patsy Morgan to divide .5 acres of land into 3 lots yielding a density of 6 units per acre located at the northwest corner of Ball Road and Denni Street; and WHEREAS, the City Council considered evidence presented by the Applicant, the Planning Commission, City staff and other interested parties at a public meeting held with respect thereto. NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows: 1. The proposed map is compatible with the o'ojectivcs, policies, general land uses and programs specified in the General Plan of the filly of Cypress in that: a. The density of development resulting from the recordation of this map will be less than that permitted by the designation xs indlccted on the Land Use Element of the General Plan. b. The adjacent streets will be improved as a condition of ibis map in accordance with the Circulation Element of the Genera! Plan. c. Approvalof this map in no way conflicts with the objectives of the other Elements of the City's General Play. 2. The design and improvement of the proposed subdivision as des irnn Lel on the tentative parcel map and supplemented by the conditions attached hereto as Exhibit "A", and incorporated herein by reference, are co meet ;S t with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. Approval of this map will provide for a development of the property in accordance with standards of development as contained in the Zoning Ordinance, and in conformance with the Land Use Element of the City's General Plan. b. The installation of improvements required as a condition of approval of the subject map will be in conformance with tic standard requirements of the City of Cypress. 3. None of the findings set forth in Government Code Section 6647- car: be made. 4. The discharge of waste from the proposed subdivision into the L community sewer system shall not result in a violation of the existin,y requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seg.). Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative parcel map, although such denial is not mandatory. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Parcel Map No. 76-6 subject to the conditions attached hereto as Exhibit "A". Drainage shall be solved to the satisfaction of the City Engineer. 2. All secondary and primary utility services shall be underground. 3. The southerly most drive approach on Denni Street and both drive approaches on Ball Road shall be removed and replaced with full -height curb, gutter and sidewalk per City of Cypress Standards. 4. The corner cutoff at the intersection of Ball Road and Denni Street shall be dedicated to the City of Cypress for roadway purposes. 5. Treewells shall be installed in the area of driveway removal. Street trees (15 gallon) shall be installed in conformance with the street tree policy of the Public Works Department. The type of trees shall be the same as those now existing at the site. 6. Soil in planting areas, including trees, shall be tested by a qualified agricultural laboratory to determine the organic and chemical amendments for optimum growth for the plants specified. The test results shall include optimum growth for the plants specified. The test results shall include concentration of nitrogen, phosphorus, potassium, pH, salinity, sodium status and boron saturation extract. Results of these tests with recommendations of the agricultural laboratory shall be furnished to the Public Works Department for approval at least 30 days prior to planting date. 7. Necessary fire hydrants shall be installed in accordance with Fire Department requirements and City Standards. 8. Plan checking and inspection fees shall be paid in accordance with Resolution No. 1713 of the Cypress City Council. 9. Developer shall conform to all applicable provisions of the City Code. 10. In accordance with the City of Cypress Master Plan of Trails, no parking shall be allowed on Ball Road or Denni Street. 11. Drainage from any lot shall not be allowed to flow across adjoining lots, unless it can be proved to the City Engineer that a definite hardship exists in draining all lots directly to the street. 12. A six -foot -high masonry wall shall be installed along the Ball Road property line and around the curb return to Denni Street from where the wall shall be reduced to a maximum height of three feet along the Denni Street frontage. The type of block shall match existing walls adjoining the subject property and shallbe constructed in accordance with City Standards, including appropriate footings which would allow for the three -foot -high wall along Denni Street to be increased in height at a later date should future residents of this property so choose. 13. All lots shall have a drainage slope of between one percent (1%) and three percent (37). 14. The Orange County Sanitation District sewer connection fee of $250.00 per unit shall be paid. In addition, a developer's tax of $50.00 per unit shall be paid, as required by the City of Cypress Business License Department. 15. The developer shall pay Recreation and Park fees in accordance with the Recreation and Park Ordinance. 16. All lots shall be connected to the existing sewer lateral on Ball Road. Sewer easements shall be granted as required. 17. The existing block wall along the westerly and northerly property line shall be maintained at a six-foot (6') height, measured from the highest adjacent grade. 18. Access to the parcels shall be designed to prevent ha_king up onto Denni Street for egress. 19. A curb ramp for the handicapped shall be provided at the intersection of Ball Road and Denni Street in accordance with the City's standards.
