HomeMy WebLinkAboutResolution No. 1826440 RESOLUTION NO. 1826 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE TRACT MAP NO. 9647 - WITH CONDITIONS. WHEREAS, an application was made by MEB Investments, to divide 1.71 acres of land into 29 lots yielding a density of 16.3 units per acre located in the 4300 block of Lincoln Avenue, and WHEREAS, the City Council considered evidence presented by the Planning Commission, the applicant, City staff and other interested parties at a public meeting held with respect thereto. NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows: 1. The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The density of development is consistent with the goals and objectives of the Land Use Element of the General Plan. b. The Map will provide for the development of a project which will supplement the housing stock within the City of Cypress for families in the middle-income range. c. The Map will facilitate a development which will be consistent with the objectives of the Lincoln Avenue Study, which was adopted as a Specific Plan for the improvement of Lincoln Avenue. 2. The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibit "A", and incorporated herein by reference, are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The design of the project and proposed improvements included therein are consistent with the general goals and objectives of the City of Cypress affording a lifestyle consistent with other projects and similar developments in other areas of the City. b. The proposed on-site improvements and development standards are consistent with the requirements of the City as outlined in the Zoning Ordinance and Building Code of the City of Cypress. 3. None of the findings set forth in Government Code Section 66474 can be made. 4. The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq.). Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative subdivision map, although such denial is not mandatory. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Tract Map No. 9647, subject to the conditions attached hereto as Exhibit "A". PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 14th day of February, 1977. All conditions of approval of Conditional Use Permit No. 76-20, as they relate to this Tentative Tract Map, shall be satisfied as a condition of approval of this application, except for the following revision: Condition No. 23, as approved by the Planning Commission, shall be revised to read: "Proposed Lot 1 shall be located a minimum distance of thirty-three feet (33') from the westerly property line, to provide adequate clearance from the entrance road (proposed street "A"). 2. An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway entrance with Lincoln Avenue. No landscaping over thirty-six inches (36") in height will be allowed in the area of the curb returns. Also, adequate sight distance shall be maintained within the development at all street and/or walkway inter- sections, to the satisfaction of the City Engineer. 3. Proposed Lot 10 shall be located a minimum distance of five feet (5') from the easterly property line to provide an adequate drainage easement for the parcels to the north of this development.
