WHEREAS, the City of Cypress, County of Orange, State of
California, did, on the 23rd day of March, 1959, pass its cer-
tain Ordinance of Intention No. 53 to order the vacation and
abandonment of that portion of Denni Street from Lincoln Avenue
to Crescent Avenue in the City of Cypress, hereinafter more
particularly described, pursuant to and in accordance with the
"Street Vacation Act of 1941" as amended, being Part 3, Division
9 of the Streets and Highways Code of the State of California;
and
WHEREAS, Nat H. Neff, City Engineer of the City of Cypress,
posted notices of street vacation of said portion of said street
conspicuously along the line of the portion of said street proposed
to be vacated, said notices being posted not more than 300 feet
apart and not less than three in all, all of which will more fully
appear from the affidavit of Nat H. Neff, the said City Engineer
of the City of Cypress, on fil': in these proceedings; and
WHEREAS, said notices so posted by the City Engineer of the
City of Cypress recited the adoption of said Ordinance of Intention
No. 53 aforesaid, and stated the date and place of the hearing when
and where all persons interested in or objecting to the proposed
vacation of said portion of said street could appear before the
City Council of the City of Cypress and offer evidence in relation
thereto; and
WHEREAS, the City Council of the City of Cypress did set Monday,
the 13th day of April, 1959, at the hour of 8:00 o'clock P. M. of
said day as the time and the Council Chambers of the City Council
of the City of Cypress located in the City Hall of the City of
Cypress as the place, for the hearing of all persons interested in
or objecting to the proposed vacation of said portion of said street;

and did continue said hearing from time to time until Monday
the 22nd day of June, at the hour of ?:30 o'clock P. M. of said
day; and
WHEREAS, there is no newspaper of general circulation printed,
Published and circulated in the City of Cypress; and
WHEREAS, the City Council of the City of Cypress has heard
the evidence, both written and verbal, of all persons interested
in the vacation of said portion of said street in this resolution
more particularly hereinafter described, and finds from all the
evidence submitted that said portion of said street described in
said Ordinance of Intention and hereinafter described is unneces-
sary for the present or prospective public street purposes; and
WHEREAS, it is the desire of the City Council of the City of
Cypress to reserve an easement in and on the easterly 15 feet of
Denni Street from Lincoln Avenue to Crescent Avenue for construc-
tion of a public sewer line;
NOW, THEREFORE, the City Council of the City of Cypress finds
and determines and hereby orders that the following described por-
tion of that certain street known as Denni Street in the City of
Cypress, described as follows:
The Easterly 15 feet of the SW 1/4 and the Westerly 15
feet of the SE 1/4 of Section 8, Township 4 S, Range 11 W.,
Rancho Los Coyotes, as shown on a map recorded in Book 51,
Page 11 of Miscellaneous Maps, Records of the County of
Orange, California,
is unnecessary for present or prospective public street purposes
and now makes its order vacating said portion of said street above
described.
Said vacation subject, however, to an easement for the con-
struction of a public sewer line in and on:

The Westerly 15 feet of the SE 1/4 of Section 8, Town-
ship 4 S, Range 11 W., Rancho Los Coyotes, as shown on
a map recorded in Book 51, Page 11 of Miscellaneous Maps,
Records of the County of Orange, California,
Said City Council further finds and determines and it is
hereby ordered, that the public easement in the portion of said
Denni Street as heretofore described, subject to the public sewer
easement heretofore described has, upon the passage of this resolu-
tion, ceased.
The City Council further orders that the City Clerk of the
City of Cypress, shall cause a certified copy of this resolution,
duly attested by him as the City Clerk under the
seal of the City,
to be recorded in the Office of the County Recorder of the County
of Orange, State of California, immediately following the passage
of this resolution.
The above and foregoing Resolution No. 92 was passed at an
adjourned regular meeting of the City Council of the City of Cypress
held on the 22nd day of June, 1959, by the following vote,
AYES:
Councilmen Arnold, Arrowood, Baroldi,
and Van Dyke
NOES: Councilman McCarney
ABSENT: None

at an adjourned regular meeting of said City Council held at
the regular meeting place thereof on the 22nd day of June,
