HomeMy WebLinkAboutResolution No. 26RESOLUTION NO. 26 A RESOLUTION OF THE CITY COUNCIL OF DAIRY CITY CALLING A SPECIAL ELECTION IN SAID CITY FOR THE PURPOSE OF SUBMIT"T'ING TO THE VOTERS OF SAID CITY THE QUESTION OF WHETHER THE NAME OF SAID CITY SHALL BE CHANCED. WHEREAS, the City Council of Dairy City has received a petition asking that the name of said City be changed from "Dairy City" to "Cypress"; and WHEREAS, said petition has been checked by representatives of the City to determine the sufficiency thereof; NOW, THEREFORE, the City Council of Dairy City DOES HEREBY RESOLVE, DETEBIINE AND ORDER as follows: Section 1. That it is hereby found and determined that a petition asking that the name of the City, to -wit: "Dairy City", be changed has been filed with the City; that said petition states the proposed name, to -wit: "Cypress". Section 2. That it is hereby found and determined that said petition is signed by not less than fifty percent (50,,x) of the qualified electors, as shown by the vote cast at the last municipal election, and is sufficient and satisfactory in all respects. Section 3. That it is hereby found and determined that there is no newspaper printed and published in the City of Dairy City. Section 4. That it is hereby found and determined that it is necessary, pursuant to law, that a special election be held for the purpose of submitting to the qualified electors of the City the question of whether the name of the City shall be changed as proposed. Section 5. That the City Clerk is hereby authorized and directed to give notice of said election by posting notice thereof conspicuously within the city limits in at least three public places and to cause publication at least once a week for four -26- Resolution No. 26 weeks prior to the election in "The Enterprise," a newspaper of general circulation within the City. Section 6. That said City shall constitute a single pre- cinct for the purpose of holding said election; that the polling place for said precinct shall be the place hereinafter designated and the hours during which the poll shall remain open are as hereinafter designated; that the persons hereinafter named, being persons qualified and entitled to vote at said election, are hereby appointed as election officers for said election as in- spector, judge, clerks and alternates, which alternates shall, in the order they are appointed, fill any vacancies of the election officers if any members appointed as election officers do not at- tend at the opening of the poll; said election officers shall hold said election, canvass and make return thereof in the time and manner provided by law. Section 7. Said notice of election shall be in substan- tially the following form: NOTICE OF ELECTION NOTICE IS HEREBY GIVEN that a special election has been called and will be held on the 6th day of August, 1957, within Dairy City for the purpose of submitting to the voters of said city the proposal of whether or not the name of said city shall be changed as proposed, that is, changed from its present name of "Dairy City" to the new name as proposed of "Cypress." That on the ballots to be used at said election, in addi- tion to any other matters required by law, there shall be printed substantially the following: OFFICIAL BALLOT DAIRY CITY NAME CHANGE ELECTION August 6, 1957 INSTRUCTIONS TO VOTERS -26A- Resolution No. 26 To vote, stamp or write a cross (+) in the voting square after the word "YES" or after the word "N0". All marks otherwise made are forbidden. All distinguishing marks are forbidden and make the ballot void. If you wrongly mark, tear, or deface this ballot, return it to the inspector of election and obtain another. T- T r ' CHANGE OF NAME PROPOSITION: Shall the present ' ' ' 'name of "Dairy City" be changed as proposed to the ' YES ' ' 'new name of "Cypress"? r r r I I t ---r ' ' NO ' ' I 1 1 r The poll for said election shall be opened at 12:00 o'clock A.M. on the day of said election and shall be kept open until 8:00 o'clock P.M. of that day, when the same shall be closed. Said district shall constitute a single election precinct for the purpose of holding said election. The polling place for said precinct shall be the place hereinafter designated, and the persons hereinafter named, being persons qualified and entitled to vote at said election, have been appointed as members of the board of election, inspector and judges, respec- tively, and as alternates for said board of election, which alternates shall, in the order in which they were appointed, fill any vacancies on the board of election if any of the members appointed to said board of election do not attend at the openinj- of the poll. Calkins Every person is entitled to vote at a special election who is registered in the precinct which composes the one special election precinct in accordance with the provisions of the Elections Code of the State of California (Election Code Section 9000). If two-thirds of the total votes cast at said election -26B- Resolution I'To. 26 are in favor of the proposed chanLe of name, the City Council shall file a statement of the holding of the election and the results thereof with the Secretary of State and with the Board of 'upervisors of Orange County. From the time of such filing the name is changed. This notice is given pursuant to the resolution of the City Council of Dairy City adopted on the 10th day of June, 1957. Jacob Van Dyke, Mayor A. E. That immediately after the close of the polls said election officers shall canvass the votes cast. The canvass shall be public, in the presence of by-standers, and shall be continued without adjournment until completed and the results are declared and posted conspicuously on the outside of the polling place; that said election officers as the precinct board shall forward to the City Clerk a certificate showing the results of said election and the number of votes cast for and against said Proposition, and they shall also forward to said City Clerk all ballots, proxies, and all other papers used at said election.
