Resolution No. 70RESOLUTION NO. 70 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, ORDERING, CALLING AUTD PROVIDING FOR A SPECIAL ELECTION TO BE HELD IN SAID CITY ON THE 24TH DAY OF MARCH, 1959, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION FOR THE ENACTMENT OF SECTION 17 OF A CERTAIN ORDINANCE. WHEREAS, there has been filed with the City Clerk a petition requesting that a certain proposition, the title of which is set forth in Section 1 hereof, be submitted to the vote of the people of the City of Cypress at a special election; and WHEREAS, the City Clerk has this date certified to the City Council that said petition is sufficient and appears to be signed by the requisite number of voters and qualifies as a referendum petition as described by law; and WHEREAS, by law the first available date for a special election is after March 16, 1959; NOW, THEREFORE, the City Council of the City of Cypress does hereby resolve, determine and order as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of Cypress on March 24th, 1959, for the purpose of submitting to the qualified voters of said City the following proposition: "PROPOSITION: Shall Section 17 of Ordinance No. 41, adopted by the City Council of Cypress, providing CEM 'Cemetery' District Regulations, be adopted?" That if the proposition so submitted receives a majority of the votes cast thereon. at such election, said section of said ordi- nance shall be enacted accordingly. Section 2. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election, and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, Resolution No. 70 -70- except as provided in Section 5734 of the Elections Code of the State of California. Section 3. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (x) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OH PEi`•CIL . ) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (x) in the voting square after the word "YES" or after the word "NO". All marks except the cross (x) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a. cross (x) with pen or pencil. PROPOSITION: Shall Section 17 of Ordinance : . No. 41, adopted by the City :YES : .• Council of Cypress, providing . CEM "Cemetery" District .• Regulations, be adopted? : : NO : •. • Section 4. If a voter stamps a cross (x) in the voting square after the printed word "YES", his vote shall be counted in favor of the adoption of the ordinance. If he stamps a cross(x) in the voting square after the printed word "NO", his vote shall be counted against its adoption. Section 5. That the City Clerk shall post in three public places notice of this election substantially in the form set forth in Elections Code Section 9751, not later than the fifty- fourth (54th) day before said election. Section 6. Said City Clerk shall post in three public places before the day of election a notice substantially in the form required by Elections Code Section 9755, the synopsis Resolution No. 70 -70A- to be the ballot proposition herein set forth.
